It is submitted that earlier the project proponent was granted fresh consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2021/16890438 dated 15.11.2021 which was valid upto 14.11.2022 for development of plotted Residential / Housing Project for 208 Plots in an area of 22110.87 Sqm with disposal arrangement-Domestic Effluent @ 250 KLD - After STP 220 KLD discharged into sewer and 30 KLD discharged onto land for plantation subject to certain terms and conditions mentioned therein.
Thereafter, the project proponent was granted extension in the validity of consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Ext/SAS/2023/20993456 dated 04.03.2023 which was valid upto 14.11.2023 for development of plotted Residential / Housing Project for 208 Plots in an area of 22110.87 Sqm subject to certain terms and conditions mentioned therein.
Now, the project proponent has applied for obtaining fresh consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for plotted Residential / Housing Project for 208 Plots in an area of 22110.87 Sqm alongwith requisite documents.
The project proponent has deposited Rs. 66960/- vide UTR No. AXOIC40334168795 dated 02.02.2024 & Rs. 48600/- vide R. No. 959609069 dated 23.04.2023 under Water (Prevention & Control of Pollution) Act, 1974 and Rs. 67460/- vide UTR No. AXOIC40334166085 dated 02.02.2024 & Rs. 48600/- vide R. No. 26287586 dated 23.04.2024 under Air (Prevention & Control of Pollution) Act, 1981. The fee deposited by the project proponent is adequate upto 31.03.2029 after adjusting late fee /penalty against the total cost of the project Rs. 828.17 lacs.
The project proponent has submitted compliance report of the conditions of the previous granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
The project proponent has submitted completion certificate issued by M/s Harit Enviro Engineers & Consultant Solutions vide Ref. no. HARIT/STP/BH/23-24 dated 24.06.2023 regarding installation of STP of capacity 250 KLD in which it has been mentioned that:
“This is to certify that we have successfully completed the work of Design, Supply, Installation, Testing & Commissioning of Sewerage Treatment Plant of Capacity 250 KLD for M/s BALAJI DEVELOPERS for their Residential Plotting Project on Kharar-Kurali Highway, Kurali Near Hotel Grand Plaza.
The STP has been successfully completed in all respects and handed over to client M/s BALAJI DEVELOPERS on dated 24.06.2023 in good working condition & we will not be responsible for any theft, physical damages of the equipment at later stage.”
The project proponent has submitted a copy of receipt regarding purchased order for automatic fully mechanized organic waste composter machine of capacity 500 kg to M/s Aneie Astecho Pvt. Ltd.
The site of the project proponent was visited by the undersigned on 19.04.2024. During the visit, it was observed as under:
1. The proposed site is situated on Kharar-Kurali Road, opposite to the Focal point chanalon.
2. The project proponent has developed entire sewer line, electricity work & fresh water collection tank at the site.
3. The individual plot owners have completed the construction work of 40 plots and construction work of 10 plots was under progress.
4. The project proponent has provided occupancy about 40 plots.
5. The project proponent has STP of capacity 250 KLD. The treated domestic effluent is being discharged onto land for plantation and remaining is being discharged into MC sewer.
6. The project proponent has proposed to install mechanical composter of capacity 500 kg/day.
7. The project proponent is complying with the conditions of the previous granted consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
In view of the above, may if approved, it is recommended that fresh consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 31.03.2029 subject to suitable conditions and following additional conditions that:
1. The project proponent shall perform / promote its Corporate Environment Responsibility (CER) activities as well as use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic.
2. The project proponent shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises.
3. The project proponent shall properly handle and manage the solid wastages as per the provisions of the Municipal Solid Waste Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner.
4. The project proponent shall maintain the record of treatment of waste water as well as shall maintain the record of energy consumption utilized for the operation of STP.
5. The project proponent shall install mechanical composter of capacity 500 kg/day within 02 months.
6. The promoter shall irrigate the green belt / area to be developed within the project area with the treated wastewater only and no fresh water will be used for this purpose as well as for construction activities within the project.
7. The promoter shall ensure the compliance of the Solid Waste Management Rules, 2016 as well as the Construction and Demolition Rules, 2016.
8. The promoter shall comply with the bye laws of the Master Plan of the area notified by the Government.
9. The promoter company shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016.
10. The promoter company shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste.
