"It is intimated that the competent authority of the Board while considering the application filed by you for obtaining fresh consent under the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981, has observed as under:
The establishment was issued show cause notice by SEIAA, Punjab to suspend the Environmental Clearance granted to the project and to issue directions u/s 5 of EPA Act, 1986 alongwith opportunity of personal hearing before Chairman, SEIAA on 03.01.2024.
Thereafter, another show cause notice was issued to the establishment vide SEIAA letter no. MS-987 dated 05.03.2024. (Copies enclosed).
The project proponent has submitted a copy of compliance report of the decisions taken by the Chairman, SEIAA, Punjab in personal hearing held on 03.01.2024 and a reply is a copy of reply w.r.t show cause notice dated 05.03.2024 as issued by SEIAA is also submitted by the PP.
On perusal of the reply it is found that the PP is yet not complied with the conditions of the Environment clearance obtained by it such as amount to be spent under its CER activities and providing adequate green area etc.
Therefore, based on the observations, the competent authority of the Board has decided to return the application of the project proponent with the direction to get the matter concluded from the SEIAA, Punjab and resubmit the application with point-wise compliance report of the Environmental Clearance (EC) conditions.
In view of above, the application is hereby returned. "
