File Note: It is intimated that earlier the industry was issued show cause notice under the violations of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 alongwith an opportunity of personal hearing before the Environmental Engineer, RO, SAS Nagar vide letter no. 2319 dated 26.05.2023. During hearing, it was decided as under: 1. The industry will ensure compliance of the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. 2. The industry shall obtain ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 within 7 days. 3. The industry shall obtain authorization under Hazardous & Other Wastes (Management & Transboundary Movement) Rules, 2016 within 7 days. 4. AEE, Regional Office, Mohali will re-visit the industry to verify the compliance and send report for taking further necessary action. Now, the project proponent has applied for obtaining ‘consent to operate’ under the Green Category for Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, for establishment of a new Warehouse, alongwith requisite documents and fees. The industry has established its unit without obtaining ‘Consent to establish’ from PPCB and has directly applied for obtaining ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The project proponent has deposited Rs. 94000/- vide R. no. 58018620 dated 27.03.2024 and Rs. 16800/- vide R. no. 459939811 dated 22.06.2023 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 94000/- vide R. no. 481866470 dated 27.03.2024 and Rs. 16800/- vide R. no. 982114671 dated 22.06.2023 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 31.10.2024, against the cost of the project of Rs. 3.76 cr. on 14.06.2023. Suitability of Site: The industry has submitted a copy of CLU issued by Department of Town and Country Planning, Punjab to M/s Kalsi Warehousing Corporation vide memo no. 6126 dated 18.07.2008 for warehousing purposes. In continuation of the same, the industry has also submitted a copy of letter issued by Directorate of Town and Country Planning Department, Punjab vide letter no. 414 dated 02.02.2024, wherein, it has been mentioned as under: “ਉਕਤ ਤੋਂ ਇਲਾਵਾ ਦਫਤਰੀ ਰਿਕਾਰਡ ਨੂੰ ਘੋਖਣ ਉਪਰੰਤ ਪਾਇਆ ਗਿਆ ਹੈ ਕਿ typographical error ਕਾਰਨ ਪ੍ਰਵਾਨਗੀ ਪੱਤਰ ਨੂੰ. 6126 ਸੀਟੀਪ(ਪਬ)/ਐਸਪੀ-432 (ਐਮ) ਮਿਤੀ 18.07.2008 ਵਿੱਚ detail of land ਦੇ serial no. 1 ਵਿੱਚ ਖਾਤਾ ਨੂੰ. 24/214 ਖਸਰਾ ਨੰਬਰ 46//13/3 (1-15) ਦਰਜ ਹੋ ਗਿਆ ਸੀ, ਜਿਸ ਨੂੰ ਕਿ ਖਾਤਾ ਨੂੰ 24/24, ਖਸਰਾ ਨੰਬਰ 46//13/2 (1-15) ਪੜ੍ਹਿਆ ਜਾਵੇ ਅਤੇ serial no. 2 ਵਿੱਚ ਖਸਰਾ ਨੰਬਰ ਅਤੇ ਰਕਬਾ 16//9/1(3-13), 12 (3/15) ਦਰਜ ਹੋ ਗਿਆ ਸੀ, ਜਿਸ ਨੂੰ ਕਿ ਖਸਰਾ ਨੰਬਰ ਅਤੇ ਰਕਬਾ 46//9/1 (3-9-11), 12 (3-1-2) ਪੜ੍ਹਿਆ ਜਾਵੇ ।” Further, the industry has submitted a copy of layout plan approved by Chief Town Planner, Punjab vide letter dated 10.09.2008 for Kalsi Warehousing Corporation in an area of 5.06 acres. As such, the site of the industry is suitable. The industry has submitted a copy of lease deed dated 27.09.2022 between Sh. Daljit Singh Kalsi and Sh. Gurmeet Singh Kalsi both being s/o Sh. Joginder Singh and M/s Torrent Pharmaceuticals Limited for khasra nos. 46//2/2 (3-2), 46//3 (3-10), 46//8/1 (2-0), 46//8/2 (1-3), 46//9/2 (0-7), 46//13/2 (1-15), 46//17 (0-10), 46//18 (4-0), 46//19 (0-17), which is valid for 06 years, i.e. 26.09.2028. In this regard, it is submitted that while processing the application of the industry, an online clarification was raised and the reply submitted by the industry w.r.t to the said observation as under: ‘Khasra plan showing the Land possession of Khasra no – 46//2/2 (3-4), 46//8/1 (2-0), 46//8/2 (1-3), land 6 Bigha- 7 Biswa with Torrent Pharmaceuticals Ltd. At: Kalsi Warehousing Corporation, Village Nimbua, Mubarkpur Sundra Road, Tehsil: Derabassi, SAS Nagar, Mohali (PB.) has been attached herewith. (Copy attached).” As such, it is clear that the owner of the warehouse (M/s Kalsi Warehousing Corporation) has leased out only a part of the complete warehouse to the occupier, i.e. M/s Torrent Pharmaceuticals Limited and the remaining portion is not in possession of the lessee (i.e. M/s Torrent Pharmaceuticals Limited). Thus, the lesser, M/s Kalsi Warehousing Corporation, needs to get the bifurcation done from the Department of Town and Country Planning in this regard. Visit:. Accordingly, the industry was visited by AEE of this office on 24.04.2024 and during visit, it was observed as under: 1. The project is a warehouse and was in operation during the visit. 2. The project proponent has installed one no. of tubewell in its premises and flowmeter is yet to be installed with the same. 3. The project proponent has constructed septic tank, after which domestic effluent is used onto land for plantation within premises. 4. The project proponent has installed any boiler, furnace, paint booth, powder coating etc., or any source of air pollution in its premises. 5. The industry has installed 01 no. DG set of capacity 125 KVA, which is provided with canopy and stack of adequate height. From above, it is clear that the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Recommendations: In view of above, if may approved, the industry may be granted fresh ‘consent to operate’ granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, upto 31.10.2024 with usual conditions & with following special conditions: 1. The project proponent shall not carry out any activity, which can change in category from Green to Orange or Red, under any circumstances. 2. The project proponent (M/s Torrent Pharmaceuticals Limited) shall operate its warehouse unit only in Khasra nos. for which the industry has obtained change of land use, layout plan approval from the Department of Town & Country Planning and agreement executed with the owner, i.e. M/s Kalsi Warehousing Corporation. 3. The industry shall comply with the by-laws of Master Plan, Derabassi as well as the guidelines of Department of Town & Country Planning, at all times. 4. The lesser (M/s Kalsi Warehousing Corporation) shall get the bifurcation of its project done from the Department of Town & Country Planning, (w.r.t part leasing of the warehouse) within 02 months and submit the same to the PPCB within 07 days thereafter. 5. The industry shall not generate and discharge any kind of trade effluent from its premises and shall discharge only domestic effluent onto land for plantation in its premises after passing through septic tank. 6. The industry shall not discharge the effluent into any drain/choe/nallah, in any case. 7. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 8. The industry shall ensure that no problem related to pollution is being caused by the unit due to its operation and no public complaints are received by the Board in this regard. 9. The project proponent shall comply with the guidelines issued by PWRDA and shall obtain permission from PWRDA for abstraction of ground water (as applicable). 10. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 11. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time. 12. The ‘consent to operate’ is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing. 13. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent. *Competency- Environment Engineer, RO (Small, Green)
