Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 26.04.2024 w.r.t. show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 to M/s R.K. Industries, St. No. 8/4, Baba Mukand Singh Nagar, Daba Road, Ludhiana.
The Following were present:

No one attended the hearing.
The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is a small scale red category unit and has applied for obtaining fresh 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974.
The application of the industry has been perused and it has been observed as under:-
1. The industry has been established without NOC of the Board and has not submitted point wise compliance of NOC conditions in annotated form.
2. The industry has not submitted copy of agreement made with M/s JBR Technologies Ltd. Ludhiana
3. The industry is newly commissioned unit and has not submitted month wise details w.r.t. water consumption and effluent generation from process from date of commissioning.
4. The industry has not submitted proof of exact date of commissioning of the unit.
5. The industry has not submitted approved building plan from Director of Factories, Punjab.
The industry was show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974with hearing before the Senior Environmental Engineer of the Board on 26.04.2024.
No one from industry attended the hearing. However, the industry has submitted written reply which has been taken on record. He submitted that the point wise compliance of NOC conditions is attached herewith. The copy of agreement with M/s JBR Technology Pvt. Ltd. Ludhiana is attached herewith. The industry has recently started its process and is started maintaining the record of fresh water consumed and untreated trade effluent lifted to M/s JBR Technology Pvt. Ltd. Ludhiana. The industry has submitted the electricity bill as proof of commissioning and same is again attached herewith. The industry will submit approved building plan from the Director of Factories within 2 months.
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The industry shall regularly lifted the spent acid to CETP operator regularly and maintain the record of water consumption and lifting.
2. The industry shall submit the record of six months of water consumptions and lifting to Board in annotated form within 15 days.
3. The industry will submit approved building plan from the Director of Factories within 15 days.
4. The industry shall submit the proof regarding date of commissioning from the competent authority within 15 days.
5. The Environmental Engineer, Regional Office, Ludhiana submit the recommendation after verifying the submission made by industry after 15 days.
