Lavneet Kumar, Senior Environmental Engineer (ZP-1) 4. Er. Navtesh Singla, Environmental Engineer (ZP-I) From the industry side: 1. Sh. Parveen Sharma, Head Compliances Manager The Environmental Engineer, Zonal Office-1, Patiala brought out that: - The industry was granted 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Varied/NSWI/2021/15247275 dated 05/05/2021 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/NSWI/2021/15295905 dated 05/05/2021, both valid upto 31/03/2024 for manufacturing of pharmaceutical products Cloxacillins (DICLOXA, OXACILLIN, FLUCLOXA) @1050MT/Year Atorvastatin @200MT/Year Rosuvastatain @50MT/Year, Amoxicillin Tryhydrate @4700MT/Year Ampicillin Tryhydrate @750MT/Year Premix @200MT/Year Pitvastatain @1MT/Year caspofungin @0.1MT/Year and by product as EHA @750 MTA, subject to the conditions mentioned therein. The industry has applied for obtaining renewal of consents to operate under the Water Act, 1974 and the Air Act, 1981 for manufacturing of pharmaceutical products Cloxacillins (DICLOXA, OXACILLIN, FLUCLOXA) @1050MT/Year Atorvastatin @200MT/Year Rosuvastatain @50MT/Year, Amoxicillin Tryhydrate @4700MT/Year Ampicillin Tryhydrate @750MT/Year Premix @200MT/Year Pitvastatain @1MT/Year caspofungin @0.1MT/Year and by product as EHA @750 MTA, as raw material alongwith requisite documents. The industry was visited by the officer of the Regional Office, Patiala on 27.03.2024 and contacted Sh. Parveen Kumar Sharma, Head Utility (WMP) and Sh. Yoginder Kumar Bhatia, Manager (WMP) of the unit. During visit, it was observed as under: 1. The storm water drain is used to channelize / collect the wastewater in collection tanks (2 nos). From these tanks the wastewater is pumped to the ETP-cum-STP. During rain, these drains would over flown and wastewater is discharged outside the industry into natural drain. 2. It has not installed water meter on all the important lines like process, domestic, miscellaneous etc so as to ascertain the actual quantity of water used in various operations / processes. 3. The separate energy meters and re-circulation meters are not installed with the APCDs installed with the various processes such as incinerator etc. No record of APCDs operation is maintained. Further, the stacks of many of these APCDs are below the roof levels of adjoining buildings 4. The HSD fired incinerator furnace as well as hot flue gas duct before the APCD are having weight loaded vents open to atmosphere. As and when, the pressure increases beyond permissible limit, these vents shall get open to emit the process / flue gas emissions to the atmosphere without any treatment. 5. The non-condensable from the outlet of condenser of Agitated Thin Film Drier (ATFD) are discharged to the open atmosphere which are considerable, visible and having odour. 6. Further, the industry has also violating the provisions of the Hazardous & Other Wastes (Management & Transboundary Movement) Rules, 2016. 7. The water containing pipelines as well as storm water drain’s colour schemes in site plan is not as per specification. 8. It is generating hazardous waste of categories 5.1, 5.2, 28.1, 28.2, 28.3, 28.4, 28.3, 28.4, 28.5, 36.2, 37.1, 37.3. 9. It is not maintaining record of categories 5.2, 28.1 and 37.1. 10. It has not obtain authorization of categories 28.1 and 37.1. 11. It is incinerating categories5.2 and 28.2 without authorization of this activity. 12. It is generating category 35.2 higher than the authorized quantity. 13. Danger sign is not displayed. Lock and key facility is not provided. The side walls is to be raised to avoid any rain shower intrusion. The cracked floor is to be repaired. 14. The solid waste is not being segregated. 15. No wet waste composting facility is provided and the same isbeing lifted by the local vendor as cattle feed. 16. The solid waste is found mixed with hazardous waste. 17. The truck loaded with solid waste was checked and observed that the hazardous waste is also packed mixed with the solid waste. The transportation documents do not contain the detail of all the wastes loaded in the truck. It is clear that the industry is not complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986, Hazardous & Other Wastes (Management & Transboundary Movement) Rules, 2016 and Solid Waste Management Rules, 2016, intentionally and deliberately. The industry is not complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention &Control of Pollution) Act, 1981. It has been proposed to refuse the consent to operate applied by the industry under the provisions of the Water (Prevention and Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 after affording an opportunity of show cause-cum-personal hearing. As such, show cause notice for refusal of the renewal of consents to operate applied by the industry under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 has been issued vide Board's letter no. 315 dated 12.04.2024 with an opportunity to appear in person before the Chairman of the Board on 23/04/2024. The representative of the industry attended the hearing and submitted written reply which was taken on record. He further submitted that the industry is in process to comply with the observations of the visiting officer of the Board and assured to comply with the environmental norms in future. After hearing the officers of the Board and the representative of the industry, the Chairman of the Board decided as under: - 1. The industry shall submit a Bank Guarantee amounting to Rs. 50.0 Lakh as an assurance to comply with the Environmental Laws, within 7 days. 2. Environmental Engineer, Regional Office, Rupnagar shall encash Rs. 5.0 lakh from the bank guarantee to be submitted by the industry as decision at Sr. No. 1. 3. The industry shall comply with the entire observations of the visiting officer of the Board within one month and submit the compliance to the Environmental Engineer, Regional Office, Rupnagar. 4. Environmental Engineer, Regional Office, Rupnagar shall visit the industry, verify the compliances, and send its concrete report / recommendations to decide the consent applications immediately, after one month. 5. It was made clear to the industry that in no case, the industry is allowed to discharge into drain. In case of failure to ensure compliance, environment compensation shall be imposed on the industry without any notice/ opportunity. 6. Further action shall be taken after the receipt of the report from Regional Office. if approved, the proceedings may be conveyed to the industry as well as Regional Office for Compliance, please.
