File Note: Sub:- Application for obtaining Fresh of Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981- Sapphire Foods India Ltd., Unit No.1. Ground Floor, Nay Nagar, Opp. Civil Hospital, Navaroop Nagar, Gaunspura, Batala, Dist Gurdaspur. It is intimated that unit is a Restaurant for ready to eat snacks established and commissioned without obtaining NOC/Consents of the Board. Now, the unit has applied for obtaining consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 through OCMMS along with requisite documents. The unit has deposited Rs. 40000/- vide online UTR No. N081242946187619 dated 21/03/2024 and Rs. 46900/- vide online UTR No. N081242946199841 dated 21/03/2024 as consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 including Rs. 6400/- as NOC regularization fee same are adequate upto 31/12/2027 under both Acts against gross value of fixed assets of the industry worth Rs. 1,30,67,001.27/- as per CA certificate submitted by the unit. The unit has submitted lease deed which is not clearly mentioning the date of start and finish. The unit has submitted property tax payment receipt issued from MC, Batala. The unit has submitted approved commercial building plan issued from MC, Batala vide no. 324 dated 09/11/2017. The industry has submitted copy feasibility report of ETP but the capacity of the ETP has not been mentioned in the feasibility report. Further, no details of daily visitors and staff has been mentioned in the feasibility report whereas, the quantity of wastewater has been mentioned @ 5 KLD. It is difficult to calculate the effluent generation without the details of no. of people visiting the restaurant. The unit was visited on 26/04/2024 and was observed as under:- 1. The unit is ready to eat snacks and was in operation during visit. 2. The unit has installed 01 no. electrical heater to fry and bake food items. 3. During visit it observed that there was no such type of utensils used by the unit which are generating wastewater during its washing. However, the unit has installed Oil & Grease Trap in its washing area and also installed ETP to treat effluent being generated. 4. During visit the ETP was found not in operation from which it is clear that the restaurant is discharging its wastewater into MC sewer without any treatment. 5. The unit has installed DG set of capacity 156 KVA which is provided with canopy but, stack of in-adequate. From the above mentioned facts, it is evident that the restaurant is not complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Therefore, show cause notice for refusal of the consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be issued to the restaurant.
