Respected Sir,
It is submitted that as per the record file, the subject cited establishment is a warehouse unit and was establishment without obtaining prior consents of the Board under the Water Act, 1974 and the Air Act, 1981. Thereafter, it had applied for obtaining fresh consent to operate under the Water Act, 1974 and the Air Act, 1981 under orange category under orange category i.e.2021-Building and construction project more than 20,000 sq. m built up area and having waste water generation less than 100 KLD in the name and style of M/s KMG Ventures LLP.
Accordingly, the application was processed this office. However, the Competent Authority has decided to return the applications with following directions:
"It is intimated that the competent authority of the Board while considering the application filed by you for obtaining fresh consent under the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981, has observed as under: The establishment was issued show cause notice by SEIAA, Punjab to suspend the Environmental Clearance granted to the project and to issue directions u/s 5 of EPA Act, 1986 alongwith opportunity of personal hearing before Chairman, SEIAA on 03.01.2024. Thereafter, another show cause notice was issued to the establishment vide SEIAA letter no. MS-987 dated 05.03.2024. (Copies enclosed). The project proponent has submitted a copy of compliance report of the decisions taken by the Chairman, SEIAA, Punjab in personal hearing held on 03.01.2024 and a reply is a copy of reply w.r.t show cause notice dated 05.03.2024 as issued by SEIAA is also submitted by the PP.
On perusal of the reply it is found that the PP is yet not complied with the conditions of the Environment clearance obtained by it such as amount to be spent under its CER activities and providing adequate green area etc. Therefore, based on the observations, the competent authority of the Board has decided to return the application of the project proponent with the direction to get the matter concluded from the SEIAA, Punjab and resubmit the application with point-wise compliance report of the Environmental Clearance (EC) conditions. In view of above, the application is hereby returned"'
Now, the project proponent has again applied for obtaining fresh consent to operate under the Water Act, 1974 and the Air Act, 1981 without concluding the matter with SEIAA, Punjab as earlier directed by the Competent Authority while returning the earlier application.
In view of above, may if approved:
1. The application of the project proponent for obtaining fresh consent to operate under the Water Act, 1974 and the Air Act, 1981, be returned.
2. Zonal Office-1, Patiala may be requested to initiate action u/s 33-A of the Water Act, 1974 and action u/s 31 of the Air Act, 1981 against the project proponent for operating its warehouse unit without obtaining prior NOC and consent to operates of the Board. |
