It is submitted that PP was issued show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 with an opportunity of personal hearing before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 15.04.2024 in which it was decided that:-
1. The consent to operate applied by industry under the Water (Prevention & Control of Pollution) Act, 1974 be refused.
2. The industry shall operate its ETP & APCD regularly and efficiently so as to achieve the prescribed standards of the Board.
3. The industry shall maintain record of fresh water consumption, effluent treated and electricity consumed in treatment of waste water on regular basis.
4. The industry shall develop proper plantation area for discharge of domestic effluent and treated trade effluent.
5. The industry shall provide stack of adequate height with D.G set, within 07 days.
6. The industry shall apply for authorization under the Hazardous and other Waste (Management &
Transboundary Movement) Rules, 2016, within 07 days.
7. The Environmental Engineer, Regional Office shall verify submission made by industry and send further recommendations in the matter to decide the air consent application.
To verify the compliance of the decisions of the said personal hearing the workshop was visited by the AEE of this office on 02.05.2024 and observed as under:-
1. The ETP and STP installed by the PP were in operation, but the Oil and Grease trap of ETP was not in operation. During visit, the samples of treated trade effluent from the final outlet of ETP and treated domestic effluent from the final outlet of STP were collected and sent to Zonal Lab for analysis and results are awaited.
2. Now, the PP has installed the water/discharge meters and started maintaining the record in this regard. During visit the readings of meter were as under:-
1. Submersible pump-1 : 38.9 KL.
2. Submersible pump-2 : 39.5 KL.
3. Pipe line leading to washing area : 53.6 KL.
4. Pipe line leading to tank for re-use of treated effluent : 61.56 KL.
5. Pipe line leading to collection tank after treatment: 1781.26 KL.
6. Pipe line leading at inlet of ETP for treatment : 1520.33 KL.
7. The reading of sub energy meter : 593.2 kWh.
3. The PP was in process to develop the plantation area in its premises, but no drawing / dimensions provided by the rep. of the PP w.r.t .area of plantation to be developed by the PP.
4. Now, the PP has provided the adequate stack height to its D.G.Set.
5. The PP has not applied for authorization under the Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016 so far.
Keeping in view of the above, It is recommended that :-
1. Consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 may be Granted to the PP upto the adequacy of consent fee i.e. upto 30.09.2028.
2. Notice u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 may be issued to PP with an opportunity of personal hearing before Competent Authority of the Board, as previous consent to operate under the Water Act, 1974 has been refused and workshop is in operation but no plantation Area has been developed by the workshop to dispose off the treated effluent yet. Hence, the possibility to dispose off the domestic effluent through unauthorized mode of disposal still cannot be ruled out.
3. Action for violation of the provisions of the Hazardous and Other Wastes (Management & Transboundary Movement) Rules, 2016 may also be initiated, as it has not applied for obtaining authorization Hazardous and Other Wastes (Management & Transboundary Movement) Rules, 2016.
