It is submitted that the industry is a small-scale red category unit. Earlier, the industry was granted consent to operate for an industrial unit u/s 25 of Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2017/5492622 dated 22.06.2017 and u/s 21 of Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2017/5492612 dated 22.06.2017, both having validity upto 30.06.2020 in the name and style of M/s Laxmi Fasteners Limited, Village Kuranwala, Barwala Road, Tehsil Derabassi, SAS Nagar for lifting of trade effluent @ 15000 ltr/month with subject to suitable conditions mentioned therein.
Now, the industry has been purchased and the new occupier has applied for obtaining fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 in the name and style of M/s KGN HARDWARE AND FASTNERS UNIT NO 2, Village Kurewala, Derabassi, SAS Nagar for manufacturing of all types of Industrial & Galvanized Screws of Various Sizes @ 900 MT/Year by using Hardened and Temperd HB Drawn Wires @ 920 MT/Year, Zinc Metal @ 4800 Kg/Year, Zinc Salt @ 3840 Kg/Year, Boric Acid @ 960 Kg/Year, Caustic Soda @ 2400 Kg/Year, Hydrocloric Acid @ 7200 Kg/year, Nitric Acid @ 0.960 KL/Year, Passivation Dip @ 1.2 KL/Year, Additive and Brightners @ 2.4 KL/Year as raw material along with requisite documents and fee.
The industry has deposited Rs. 72,500/- vide UTR. No. N116243003996638 dated 25.04.2024 under Water Act, 1974 including application form fee and Rs. 86,400/- vide UTR. No. N116243004010582 dated 25.04.2024 (Rs. 72,000/- under Air Act, 1981 & Rs. 14,400/- as NOC fee), against the fixed assets of Rs. 474.66 lacs as on 20.04.2024. The consent fee deposited by the industry is adequate upto 31.03.2029 under both acts.
The industry has submitted GST registration certificate vide no. 03AASFK6450C1ZG dated 14.11.2017 in the name and style of M/s KGN HARDWARE and FASTENERS, Barwala Road, Vill. Bhagwanpura, Derabassi, SAS Nagar as partnership firm and authorized partners i.e. Sh. Minhaz Ali, Sh. Shahjan Ali.
The industry has also submitted partnership deed made on 23.10.2017 between Sh. Shahjan Ali S/o Sh. Mashuk Ali and Sh. Minhas Ali S/o Sh. Makhmool Ali for manufacturing of & trading of screws, nuts, bolts and other related products in the name and style of M/s KGN Hardware & Fasteners.
The industry has submitted sale deed issued on dated 31.01.2024 between M/s Laxmi Fastners Ltd. (First Party) and M/s KGN Hardware and Fasteners (Second Party) for area of land measuring 5.0 Bigha 6.0 Biswa.
The industry has submitted land classification certificate issued by DTP vide no. 295 dated 06.03.2024, as per which the site falls in existing industrial zone as per Master Plan Derabassi.
The industry has submitted approved site plan prepared by Er. Daljit Raheja competent person from Director of Factories, Punjab.
The industry was visited by AEE of this office on 04.05.2024 and it was observed as under:
1. The industry was in operation during visit and engaged in manufacturing of screws.
2. The manufacturing process of the industry is as under: -
Manufacturing of Screws: - Drawn wire of various Dia—Pay Off—Header Machine—Slothy M/c—Thread Rolling M/c—Electroplating—Packing.
Manufacturing of Electro Plating: - Soak Cleaning—Water Rinse—Acid Pickling—Water Rinse—Anodic Cleaning—Water Rinsing—Surface Activation / Neutralization—Water Rinse—Zinc Plating—Water Rinse—Nitric Acid Activation—Water Rinse—Drawing—Hydrogen DE-Embrittlement—Cooling at Room Temperature—Plating—Water Rinse—Nitric Activation—Passivation—Water Rinse—Drawing—Packing.
3. The industry has installed 44 nos. headers, 28 nos. thread making machines, 02 nos. heat treatment furnaces (electrical heaters) and one zinc plating plant (12 barrels).
4. The industry has made agreement on dated 20.04.2024 with M/s Bantech Water Private Limited for lifting of trade effluent @ 15000 ltr.
5. The industry has installed two tanks of sizes 7'x5'x6' and 7'x7'x6' for storage of trade effluent.
6. The industry has provided fresh water meter in the process and was advised to maintain the record regarding fresh water consumption and disposal of trade effluent on daily basis.
7. The domestic effluent is discharge onto land for plantation after passing through septic tank.
8. The industry has installed one no. D.G set of capacity 320 KVA, which is equipped with canopy and adequate stack height.
In the view of above, it is recommended that the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30.06.2028 with subject to suitable conditions and special conditions that: -
1. The industry shall maintain proper record of the fresh water to be consumed in its process at all times.
2. The industry shall get its trade effluent lifted through operator of CETP, only and shall maintain a proper record of lifting of the same, at all times.
3. The project proponent shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
4. The industry has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments.
5. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
6. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time.
7. The industry shall ensure that the activity of unit does not create any nuisance in the surrounding areas and no public complaints are received.
8. The Consent is being issued to the industry based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
9. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
