File Note: It is intimated that the subject cited industry has applied for obtaining consent to establish (NOC) from pollution angle under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for the establishment of stone crusher unit. The Sub Divisional Magistrate, Pathankot vide letter no. 283 dated 21/03/2024, reported that the site of the industry is situated in Village-Feroza, Tehsil & District-Pathankot in Khasra No. 4//11-12/1 Kitta 2 Rakba 13 Kanal 12 Marlas. As per the SDM, Pathankot report, the site is situated at more than 5 KM from MC Limit of Municipal Corporation. The site is situated more than 2 KM from A-Class City and more than 1.5 KM from B-Class Town. The site is situated more than 1 KM other towns and cities limits. The site is located more than 500 meter from village-Lal Lakir/Phirni/Approved Residential Area (15 Pucca House)/Wild Life Sanctuary/Zoological Park. The site is situated more than 300 meters from Historical Place/Educational Institute/Protected Monument. The site is situated more than 500 meter from National Highway/State Highway/Scheduled Road & more than 100 meter from Link Road and more than 500 meter from District Road. The site of the situation more than 50 meter from the outer edge of the Gair Mumkin Nadi, Choe, etc or similar nomenclature identifying water body on the outer/flowing side of the choe-river 50 meter. No River Embankment exists. The site of the industry is located within 30 KM from International Border. The Executive Engineer, Drainage Department, Gurdaspur vide letter no. 1946/6-W dated 16/04/2024 reported that, the distance of stone crusher from flood protection embankment of the outer side slope of the River Ravi is more than 50 meters. The District Forest Officer (Wild Life), Pathankot vide letter no. 2752 dated 14/03/2024, reported that the site of the industry is situated at 1800 meter from Sanctuary Kathalour and 2300 meter from Kaushalya sanctuary. The industry has submitted policy of Government of Punjab, Department of Industries & Commerce, Notification dated 17.11.2017 which states as under:- “In pursuance of the approval of the Council of Ministers, Government of Punjab conveyed vide no. 1/152/2017-1Cabinet/4639 dated 16.10.2017, the Governor of Punjab is pleased to notify ‘Industrial and Business Development Policy’ 2017 as per Annexure – A i.e. 10.19.2 (i) No CLU will be required in this Extreme Border Zone to set up industry. (ii) 100 % exemption from EDC charges. (iii) 75 % exemptions of all the State duties, taxes and fees such as Rural Development Fee, Market Development Fee, State Excise Duty etc. to the first unit, which comes into operations in EBZ for each sector of manufacturing and service industry. If there are higher incentives available under any other section of the policy, then the same would also be available to these units.” As per the project report submitted by the industry, the industry has proposed to install One no. Jaw Crusher, 1 no. Rotopactor, One no. Granulator, 2 no. Vibrator, One no. Sand Screw/Sand Washer. The industry has proposed to install one no. D.G. set of capacity 160 KVA with canopy and adequate stack. The industry will generate trade effluent from washing @ 45 KLD and same will be 100% re-circulated after passing through settling tanks. The domestic effluent will be generated @ 0.5 KLD and same will be discharged into septic tank. The industry was visited by the officer of the Board on 01/05/2024 and observed that no physical construction has been started at the site. The site of the stone crusher is currently being used for agriculture purpose. No residential house/Mandir/ Gurudwara was found within 500 meters radius of the site. The industry has demarked the area of the site with the pillars (Agenda Note is also attached herewith). In view of above, It is recommended that consent to establish (NOC) from pollution angle may be granted to the industry for one year period and with following special conditions :- 1. The industry shall obtain consent to operate from the Board before starting the operation of the industry. 2. The industry shall obtain necessary approvals/permissions from other concerned departments before the commissioning of project. 3. The industry shall comply with the guidelines/code of practice and standards prescribed by the Board for stone crushers. 4. The stone crusher shall comply with the orders of NGT in O.A. No 57/2020 or any relevant orders of Competent Authority in related matter. 5. The above said consent to establish for one year period or till it has legal source of raw material certified by Department of Mines and Geology, whichever is earlier. 6. The stone crusher shall maintain the plantation cover around the periphery so as to comply with the code of practice. 7. The stone crusher shall comply with the orders of NGT in O.A. No 57/2020 or any relevant orders of Competent Authority in related matter. 8. The stone crusher shall comply with the new Environmental Guidelines issued by the CPCB for the stone crushing unit.
