Respected Sir,
It is submitted that as per the record file, the establishment had earlier obtained consent to establish vide CTE/Fresh/PTA/2021/16810208 dated 21/10/2021, valid upto 05/10/2022 for establishment of warehouse in an area measuring 34580.38 Sqm, having built up area of 19648 Sq.mt/day under orange category with suitable conditions mentioned therein.
Thereafter, the industry had earlier applied for obtaining fresh consents under the Water Act, 1974 and under the Air Act, 1981 for operation of the proposed warehouse under green category.
Accordingly, the site was visited by the officers of the Board on 26.02.2024. During visit, it was observed that:
1. The establishment is a warehouse project and found in operation.
2. The establishment has provided 2 no. of sheds.
3. The representative of the project Sh. Rajesh Kumar was contacted on his mobile no. 7253848883 and he informed that 1 no. of shed which is having built up area of 2.2 lac sq.ft. is complete and is 70% occupied by M/s Mahindra & Mahindra and other shed of built up area @ 1.8 lac sq.ft. is under construction and is lying vacant. Therefore, the total built up area will be 4.0 Lac sqft (approx. 37162 sqm)
4. He further informed that waste water from domestic source is collected in septic tanks & will be lifted by movable tankers after filling.
Due to the observations raised by this office, a show cause notice for refusal of consent to operate applied by the project proponent under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 was issued to the establishment vides Board letter no. 12698 dated 14.03.2024.
Thereafter, the establishment had submitted is reply to the show cause notice on 16.03.2024. However, the reply of the godown/ warehouse was not complete as the godown/ warehouse has submitted building plan of one shed out of the total two sheds and has made wrong statement it has only shed in its premises. Secondly, the godown/ warehouse has not given any reply regarding wastewater treatment of domestic wastewater generated by it.
The matter was considered by the competent Authority of the Board and it was decided that the consents to operate applied by the godown/ warehouse may be refused due to reasons mentioned in the show cause notice issued to the project proponent by the Board.
Accordingly, the application applied by the project proponent for obtaining consent to operate under the Water Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 were refused vides no. CTOW/Fresh/PTA/2024/19808976 dated 31.03.2024 and vides no. CTOA/Fresh/PTA/2024/19801243 dated 31.03.2024, respectively.
Now, the project proponent has again applied for obtaining fresh consent to operate under the Water Act, 1974 and the Air Act, 1981 without submitting any compliance to the conditions on which its earlier applications were refused. Moreover, the project proponent in its latest application form has not mentioned any detail regarding the total built up area and details regarding consumption, generation and disposal of fresh water as well as wastewater, is kept blank.
In view of above, may if approved:
1. The application of the project proponent for obtaining fresh consent to operate under the Water Act, 1974 and the Air Act, 1981, be returned.
2. Zonal Office-1, Patiala may be requested to initiation action u/s 33-A of the Water Act, 1974 and action u/s 31 of the Air Act, 1981 for operating its unit without obtaining valid consents of the Board.
