Earlier, the industry was given personal hearing before the Chief Environmental Engineer, Ludhiana on 28.03.2024 w.r.t notice to issue directions u/s 33-A of the Water Act, 1974 and u/s 31-A of the Air Act, 1981 under the name & style of M/s Makhan Sewing Machine Co., C-99, Phase-V, Focal Point, Ludhiana, wherein, it was decided as under:
1. Consent to operate granted to industry under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 be revoked.
2. The directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 be confirmed for closure of the industry and for disconnection of its electric connection.
3. The Environmental Engineer, Regional office shall issue show cause notice to M/s Moonlight Auto Forgings Pvt. Limited not to establish any unit without NOC of the Board and shall submit its report within 15 days.
However, M/s Makhan Sewing Machine Co. has submitted a request letter stating that their Plot No. C-99, Phase-V, Focal Point, Ludhiana was sold to M/s Moonlight Auto Forgings Pvt. Ltd. On dated 30-01-2024 and authorize to M/s Moonlight Auto Forgings Pvt. Ltd. to apply the NOC and consent to operate granted to industry under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.”
In compliance, M/s Moonlight Auto Forgings Pvt. Ltd. has applied for obtaining ‘consent to establish'/ (NOC) under the Water Act, 1974 and Air Act, 1981 with requisite documents.
The proposed site was visited by RO on 02.05.2024 and it was reported as under: 1. The firm has erected some columns for industrial shed. No construction activity was observed at site during visit. It has also not installed any plant and machinery. 2. It has proposed Tow Hook / Eye Bolt @ 16,000 Numbers/day by using raw material as Round Bars @ 8 MTD. 3. The proposed manufacturing process is Raw material – Cutting - Heating – Rolling – Bending - Forging - Trimming - Coining – Heat Treatment – Inspection – Packing - Dispatch. 4. First phase It has proposed to install 1 no. Normalizing Furnace of capacity 400 Kg/hr, 1 no. Hardening & tempering furnace of capacity 300 kg/hr, 1 no. Forging Press of capacity 1000 Ton and 1 no. Induction billet heater with allied machinery. 5. Second phase It has proposed to install 1 no. Normalizing Furnace of capacity 400 Kg/hr, 1 no. Screw Forging of capacity 150 Ton, 1 no. Hardening & tempering furnace and 1 no. Forging Press of capacity 400 Ton. 6. The industry has proposed to install 1 no. DG set of capacity 900 KVA, which will be equipped with canopy. Apart from DG set, it has not proposed any air polluting machinery as all the proposed furnaces will be operated on electricity. 7. There will be no generation of trade effluent. 8. Domestic effluent @ 0.35 KLD will be discharged into sewer. 9. The proposed site of the industry is located in the designated Industrial Focal Point, Ludhiana as per Master Plan of Ludhiana. 10. The industry has submitted lease deed, which is valid upto 31.12.2028.
The industry is located in Industrial zone as per Master Plan (2010-2031) of Ludhiana. Therefore, there is no requirement of Site Clearance u/s 41 (A) of the Factories Act, 1948.
In view of the above, it is recommended that the industry may be granted ‘consent to establish'/ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for one year with suitable conditions as per policy of the Board with additional condition that the industry shall apply for restoration of electric connection after compliance of NOC conditions alongwith consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
