It is submitted that the unit is a green category small scale hotel and has applied for obtaining NOC/consent to establish under the Water Act, 1974 and the Air Act, 1981 for Restaurant @ 1 Numbers, Rooms @ 5 Numbers and Banquet Hall having capacity 30 Persons @ 1 Numbers at NH-7, Kothe Gobindpura, VPO Dhanaula, District Barnala without generating trade effluent and any air pollution. However, the project proponent will generates domestic effluent @ 4 KLD which will be discharged onto land for plantation after passing through septic tank.
The project proponent has deposited NOC fee of Rs. 6400/- vide UTR No. 337274940 dated 15.04.2024 against the proposed project cost of Rs. 133.21 lakhs, which is adequate for one year.
The project proponent has submitted CLU-cum-building plan issued by Senior Town Planner, Patiala vide memo letter no. 144 STP(P)/SP-327 dated 18.01.2024, according to which total land measuring is 14 kanal 17 marle (1.856 acres). The site falls in Notified Local Planning Area, Dhanaula-Longowal.
The project proponent has submitted partnership deed executed on 01.04.2023 as per which there are 02 no. partners namely Sh. Sukhwinder Singh s/o Sh. Amrik Singh (50%) and Sh. Harvinder Singh s/o Sh. Amrik Singh (50%).
The project proponent has submitted power of attorney letter as on 07.04.2023 as per which Sh. Harvinder Singh s/o Sh. Amrik Singh is the authorized signatory of the project proponent.
To verify the facts, the site of the hotel was visited by the officer of this office on 23/04/2024 and it was observed as under:-
1. The site of hotel is located at VPO Dhanuala, District Barnala outside the MC limits of Barnala.
2. The project proponent has proposed to develop Restaurant @ 1 Numbers, Rooms @ 5 Numbers and Banquet Hall having capacity 30 Persons @ 1 Numbers at NH-7, Kothe Gobindpura, VPO Dhanaula, District Barnala in an area of 14 kanal 17 marle (1.856 Acres) outside MC limits of Barnala.
3. Further, no terminal STP has been installed in Dhanaula. As per Board's notification dated 2.02.2021 regarding guidelines for control of pollution in hotels/motels/banquet halls, restaurants etc. the establishments which are not connected to the city STPs, shall provide captive ETPs/STPs for treatment of effluent generated from their premises and shall make necessary arrangements for reuse the treated effluents including disposal onto land for plantation. However, the project proponent with present application has only proposed to install the septic tanks. Further, the project proponent has also not submitted the details regarding disposal of its solid waste and compliance of the Board's notification dated 02.02.2021.
Hence, the proposal given by the project proponent is not environmentally sound.
In view of above, it is recommended that show cause notice for refusal of consent to establish/NOC be issued to the project proponent, please.
