File Note: It is submitted that the Project Proponent has applied obtaining Consent to Establish (NOC) of the Board from pollution angle for establishment of hotel with 18 rooms and 01 no. banquet hall of capacity 500 persons under small scale / orange category unit in an area of 17 kanals 19 marlas bearing khewat no. 114, khatoni no. 159, khasra no. 234//16/1(2-16), 17(8-0), 7/2/1(0-8), 14/1/2(0-14), 14/2/2(2-16), 14/3/2(2-5), 14/2/2(1-0) in the revenue estate of village Baghapurana-1, Tehsil Baghapurana, District Moga. Details of the case is as under:- 1. The Project Proponent has submitted copy of DTP report vide memo no. 23 DTP(Moga)/IND-1 dated 03.01.2024, relevant part of which is reproduced as under: "ਵਿਸ਼ੇ ਅਧੀਨ ਸਾਈਟ ਬਾਘਾ ਪੁਰਾਣਾ — ਨਿਹਾਲ ਸਿੰਘ ਵਾਲਾ ਰੋਡ (ਐਨ.ਐਚ.—254) ਤੇ ਬਾਘਾ ਪੁਰਾਣਾ ਤੋਂ ਨਿਹਾਲ ਸਿੰਘ ਵਾਲਾ ਵੱਲ ਜਾਂਦਿਆਂ ਸ਼ਹੀਦ ਭਗਤ ਸਿੰਘ ਚੌਂਕ ਤੋਂ ਲਗਭਗ 2.7 ਕਿਲੋਮੀਟਰ ਦੀ ਦੂਰੀ ਤੇ ਸੱਜੇ ਹੱਥ ਪਿੰਡ ਬਾਘਾ ਪੁਰਾਣਾ —1 ਦੀ ਰੈਵੀਨਿਊ ਅਸਟੇਟ ਵਿੱਚ ਪੈਂਦੀ ਹੈ। ਸਾਈਟ ਮੌਕੇ ਤੇ ਖਾਲੀ ਹੈ। ਸਾਈਟ ਨੋਟੀਫਾਈਡ ਮਾਸਟਰ ਪਲੈਨ, ਬਾਘਾ ਪੁਰਾਣਾ (2010—31) ਦੇ ਰਿਹਾਇਸ਼ੀ ਜੋਨ (ਆਰ.ਡੀ.—2, ਲੋ ਡੇਨਸਿਟੀ) ਵਿੱਚ ਪੈਂਦੀ ਹੈ। ਆਨਲਾਈਨ ਪ੍ਰਾਪਤ ਫਾਰਮ ਨੰ: 2 ਦੇ ਲੜੀ ਨੰ: 3.2 ਅਨੁਸਾਰ ਸਾਈਟ ਵਿੱਚ ਹੋਟਲ ਸਥਾਪਿਤ ਕਰਨ ਦੀ ਤਜਵੀਜ ਹੈ, ਜੋ ਕਿ ਯੂਨੀਫਾਈਡ ਜੋਨਿੰਗ ਰੈਗੂਲੇਸ਼ਨਜ਼ ਲੈਂਡ ਡਿਵਲਪਮੈਂਟ ਕੰਟਰੋਲਜ਼ ਅਨੁਸਾਰ ਰਿਹਾਇਸ਼ੀ ਜ਼ੋਨ ਵਿੱਚ ਆਗਿਆਯੋਗ ਹੈ।" 2. The Project Proponent has submitted copy of feasibility report regarding installation of waste water treatment facility consisting of Bar Screen > Grit Chamber > Oil & Grease Trap > Septic Tank. As per feasibility report, the site will discharge 15 KL treated wastewater onto land for plantation developed in 2 kanals within the premises. Solid waste generated from the premises will be lifted by the MC authorities. 3. The Project Proponent has submitted copy of project report, showing value of gross fixed assets of Rs. 2.15 crore (including land = Rs. 50 lakhs, building = Rs. 70 lakhs, machinery = Rs. 15 lakhs). Accordingly, the Project Proponent has deposited NOC fee of Rs. 10800/- vide UTR / Ref. No. 769971514 dated 28.02.2024, which is adequate for one year. 4. The Project Proponent has submitted copy of partnership deed executed on 19.05.2023 among its 04 no. partners (Sh. Amit Goyal, Sh. Ritik Goyal, Sh. Lovekesh Arora and Sh. Tinu Kumar). 5. The Project Proponent has submitted copy of revenue record such as registry of land and jamabandi. 6. The Project Proponent has submitted copy of aks chajra, latha, site plan for the proposed site. The proposed site was visited by undersigned (AEE) on 25.04.2024 and it was observed as under: 1. The site falls on right hand side of Baghapurana – Nihal Singh Wala Road and 2.7 km from Shaheed Bhagat Singh Chowk. 2. The site falls outside the MC limit. 3. The boundary wall has been constructed at proposed site and structural work was going on at site. The proposed site is complying with the provisions of the Water Act, 1974 & the Air Act, 1981 and is suitable for establishment of hotel with 18 rooms and 01 no. banquet hall of capacity 500 persons. Keeping in view of above, it is recommended Consent to Establish (NOC) under the Water Act, 1974 & the Air Act, 1981 may be granted to Project Proponent for establishment of hotel with 18 rooms and 01 no. banquet hall of capacity 500 persons with suitable conditions alongwith specific conditions as under: 1. The consent to establish (NOC) is being issued, subject to permission from Department of Town & Country Planning regarding establishment of new hotel cum banquet hall, in land area measuring 17 kanals 19 marlas bearing khewat no. 114, khatoni no. 159, khasra no. 234//16/1(2-16), 17(8-0), 7/2/1(0-8), 14/1/2(0-14), 14/2/2(2-16), 14/3/2(2-5), 14/2/2(1-0) in the revenue estate of village Baghapurana-1, Tehsil Baghapurana, District Moga. 2. The Project Proponent shall obtain necessary statutory clearances for establishment of hotel cum banquet hall from other departments. 3. The Project Proponent shall submit building plan approved by the Competent Authority while obtaining Consent to operate under the Water Act, 1974 & the Air Act, 1981. 4. The permission is granted from pollution angle and shall obtain all clearances from other departments. 5. The Project Proponent will always comply with guidelines issued by the Board vide no. HQ-2/2021/64 dated 02.02.2021. 6. The Project Proponent will comply with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 and subsequent amendments, if any. 7. The Project Proponent will develop plantation area in 2 kanals within the premises for discharge of treated domestic effluent. 8. The Project Proponent will provide compost pits for treatment of wet solid waste and disposed dry solid onto nearby MC disposal site through covered vehicle.
