It is submitted that the hospital has applied for obtaining consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for having 45 beds capacity alongwith requisite documents.
The hospital has deposited Rs. 14000/- vide UTR. No. P115230236887914 dated 25.04.2023 under Water (Prevention & Control of Pollution) Act, 1974 and Rs. 10000/- vide UTR. No. P255230266521589 dated 21.09.2023 under Air (Prevention & Control of Pollution) Act, 1981. The fee deposited by the hospital is adequate upto 28.02.2029 under both Acts.
The hospital has submitted building plan approved by Er. Lokinder Bansal, Competent Person under Director of Factories, Punjab. The hospital has submitted completion certificate regarding installation of ETP-cum-STP of capacity 15 KLD. The hospital has submitted an agreement executed with M/s Rainbow Environments Pvt. Ltd., Village Balyali, Tehsil Kharar regarding lifting of Bio-Medical waste and same is valid upto 19.02.2026 for 45 beds.
The hospital has submitted analysis report of the effluent sample (ETP-cum-STP Outlet) carried out by M/s Punjab Biotechnology Incubator on 09.05.2023, the conc. of the parameters were found within the permissible limits of the Board as tabulated below:

It is further submitted that as per Board’s office order no. 379 dated 27.10.2023 for grant of consents to operate under the Water Act, 1974, the Air Act, 1981 and authorization under the Bio-Medical Waste Management Rules, 2016 as amended from time to time to Health Care Facilities (HCFs) in which it has been mentioned that:
“Precisely stated, the Ministry of Environment, Forest and Climate Change (MoEF&CC), Govt. of india, vide notification dated 19.02.2019 has made the amendment in the Schedule-l appended to the Bio-Medical Waste Management Rules, 2016 to the effect that Health Care Facilities having less than ten beds shall have to comply with the output discharge standard for liquid waste by 31st December, 2019. However, the Indian Medical Association (IMA), Punjab had submitted various representations from time to time and on 09.10.2023 wherein PPCB has been requested to grant consents to operate under the Water Act, 1974, the Air Act, 1981 and authorization under the Bio-Medical Waste Management Rules, 2016 to Health Care Facilities (HCFs) without installation of STP -cum-ETP by medium level hospitals due to the various reasons as mentioned in their representations.
3) After considering the representation submitted by the IMA Punjab and examination of the matter, the Competent Authority of the Board has decided to constitute a committee of technical officers of the Board comprising of various hierarchical positions vide office order no. 378 dated 27.10.2023 to examine the matter in detail, practice adopted by the other State Boards, letters/clarifications/guidelines issued by the MoEF&CC/CPCB etc., if any and to submit the report for taking further action in the matter.
4) In view of the above stated facts it has been decided that HCFs up to 30 bed capacity which are discharging their liquid waste into public sewer and operating within MC limits of towns, where terminal sewage treatment plants (STPs) have been installed, shall be granted consents to operate. under the Water Act, 1974 and the Air Act, 1981 as well as authorization by Punjab Pollution Control Board (PPCB) without installation of individual ETPs, as an interim arrangement, subject to the condition that HCFs shall ensure to comply with the effluent standards as notified by the Ministry of Environment, Forest and Climate Change under Bio-Medical Waste Management Rules, 2016 as amended upto to date and subsequent amendments if any.
5) This order will supersede the earlier office orders passed by the Board with regard to the issue aforementioned and shall come into with immediate effect.”
The site of the hospital was visited by the undersigned on 26.04.2024. During the visit, it was observed as under:
1. The HCF has expanded for 45 beds.
2. The HCE has provided color coded bins for the segregation of Bio Medical Waste generated in the premises of hospital.
3. The HCF has provided submersible pump as source of fresh water.
4. The HCF has installed ETP-cum-STP of capacity 15 KLD for treatment of effluent generated from the HCF. After treatment in STP, the treated wastewater is being discharged into sewer. The HCF is maintaining the record of operation of ETP-cum-STP.
5. The HCF has installed a DG set for capacity 62 KVA having canopy and stack height of adequate height.
6. The hospital is maintaining record of lifting of bio-medical waste to the CBWTF operator.
7. The hospital is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981 & Bio-Medical Waste Management Rules, 2016.
In view of the above, may if approved, it is recommended that consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30.09.2028 subject to suitable conditions and following additional conditions that:
1. The hospital shall not increase its bed capacity without obtaining prior written permission of the Board under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
2. The Hospital shall comply with the provisions of the Bio-Medical Waste Management Rules, 2016.
3. The hospital will renew its agreement with the CBWTF for lifting of its BMW before expiry of the same.
4. The hospital will submit Annual Report on Bio-Medical Waste Management in Form-IV by 30th June every year.
5. The hospital shall got lifted/handed over its Bio-Medical Waste generated to the Common Bio-Medical Waste Treatment Facility on daily basis.
6. The hospital shall obtain other statutory approvals required from other departments, if any.
7. The hospital shall comply with the Board’s office order no. 601 dated 16.12.2021 and its subsequent amendments, if any.
