It is intimated that the poultry farm is a small scale (as per value of plant & machinery) green category unit. The poultry farm has been established without NOC/consents of the Board.
It is intimated that the CPCB has framed Environmental Guidelines for layered poultry farms in August, 2021. As per the said guidelines, the poultry farms are classified as under:
1. Small (5,000-25,000 bird)
2. Medium (above 25,000-1,00,000 birds).
3. Large (above 1,00,000 birds)
Now, the poultry farm has applied for obtaining fresh consent to operate under the Water Act, 1974 and the Air Act, 1981 without obtaining NOC of the Board for production of eggs @ 60,000 Numbers/Day & feed 10 T/day by using Layer Birds @ 78,000 Numbers/Day, Chicks @ 12,000 Numbers/Day & Maize, Soya, Mustard, Sun Flower, DOC, Bazra, Lime Stone & GNE @ 10 T/day as raw material under medium scale green category. However, as per the categorization of the industry into large/ medium/ small scale is being carried out by the Board on the basis of total value of the plant & machinery of the industry. The value of the plant & machinery of the poultry farm is 20.12 lakhs which is less than 5 cr, hence, it falls under small scale and competency to decide the case lies with Environmental Engineer, RO.
The poultry farm had already deposited Rs. 34,010/- vide no. 531252898 dated 27.04.2022, Rs. 24,000/- vide no. 205046002 dated 01.06.2022, Rs. 50,400/- (Rs. 42,000/- consent fee + Rs. 8400/- NOC fee) vide no. 746821244 dated 29.06.2021 under the Water Act, 1974 and Rs. 47,500/- (Rs. 42,000/- consent fee + Rs. 5,000/- under VDS scheme + Rs. 500/- application fee) vide no. 458619567 dated 29.06.2021, Rs. 34,000/- vide no. 772884252 dated 27.04.2022 and Rs. 24,010/- vide no. 148366022 dated 01.06.2022 under the Air Act, 1981, against the value of total fixed assets of Rs. 73.43 lakh as per CA certificate certificate dated 06.03.2024, which is adequate upto 31.12.2058.
According to sale deed executed on 13.07.2023 and undertaking submitted by the poultry farm earlier, the poultry farm was run in the name & style of M/s Safal Poultry Farm run by three partners namely Sh. Lajpat Rai, Sh. Jiwan Parkash Bansal and Sh. Sanjeev Bansal.Sh. Jiwan Parkash Bansal and Sh. Sanjeev Bansal has sold their shares to Sh. Lajpat Rai and now Sh. Lajpat Rai is the sole proprietor of the firm and run the firm in the name & style of M/s Punjab Poultry Products.
An undertaking has been submitted by the poultry farm that this poultry farm is operating since 1994 by different no. of firms. Now, Sh. Lajpat Rai is sole proprietor operating the firm from 12 July, 2023. However, no concrete proof regarding operation of the poultry farm from 1994 had not submitted by the poultry farm.
The poultry farm has submitted letter from the Office of SDM, Barnala vide letter no. 945 dated 18.04.2022, regarding distance criteria of the poultry farm. There is no major water courses like river, lake and canals in area of 200 mtr, there is no state highway, drinking water source like well, summer storage tanks, other tanks in area of 100 mtr. There is also no National Highway in area of 150-200 mtr of the poultry farm. It is also stated that there are 03 no. houses, 01 no. cow farm in area of 500 mtr of the poultry farm. The boundary wall of poultry farm is just on Khudi Kalan to Patti Sohal road. Hence, the poultry farm is not complying with the siting condition that it should be located at least 10-15 m from rural roads/internal roads/village pagdandis. Copy of the revenue report is also attached in the list of documents for kind perusal.
To verify the facts, the poultry farm was visited by the officer of this office on 11.03.2024 and it was observed as under:-
1. The poultry farm was in operation having 03 double story sheds and 01 chick shed having total 78,000 birds and 12,000 chicks. The poultry farm provided nipple system for drinking purpose of birds.
2. There is no approved residential zone, poultry/dairy, zoo sanctuary in the radius of approx. 500 mtr from the site of the poultry farm. However, there are 03 no. houses, 01 no. cow farm in area of 500 mtr of the poultry farm. There is no any water body and national highway in the radius of approx. 200 mtr, there is no drinking water source and state highway in the radius of approx. 100 mtr from the site of the poultry farm.
3. The poultry farm has provided the deep burial pit with cover for the disposal of dead birds.
4. The birds littering is supplied to the farmers as manure as free of cost by the poultry farm. During visit, no flies were observed at site.
5. The poultry farm has own feed mill with provided cyclone as APCD.
6. The domestic effluent generated from poultry farm was being discharged onto land for plantation after passing through septic tanks.
7. The poultry farm is not generating trade effluent.
8. Holding tanks are made for collection of water arising from the shed during washing or in rainy season.
9. The poultry farm has installed one D.G set of capacity 75 KVA with canopy.
Thereafter, the poultry farm was issued show cause notice for violating the provisions of the Water Act, 1974 and the Air Act, 1981 vide letter no. 1338 dated 27.03.2024 with an opportunity of personal hearing before the EE, RO, Sangrur.
Sh. Pashal Garg s/o Sh. Lajpat Rai, Proprietor of the poultry farm appeared before Environmental Engineer, Regional Office, Sangrur on 05.04.2024 and informed that this poultry farm is operating since 1994 by different no. of firms. Now, Sh. Lajpat Rai is sole proprietor operating the firm from 12 July, 2023. He further informed that no addition in the building/poultry shed has been made and it is operating at the same location. He also stated that poultry sheds are located 20-25 mtr from the boundary wall, hence, it is complying with the guideline applicable on them.
After hearing the representative of the poultry farm and officer of the Board, it was decided that concerned AEE to check documentation and contention made by the poultry farm during hearing and shall submit comments along with fresh recommendations to decide the consent applications of the poultry farm on merits.
Proceedings of the personal hearing has been conveyed to the poultry farm vide no. 2254 dated 03.05.2024.
The documents submitted by the poultry farm has been checked by the undersigned and found that the poultry farm was established and is in operation since 1994 by different no. of firms (constituting various different partners/proprietors) in an area of 17 kanal 18 marla. In year 2010, the poultry farm was purchased by M/s Safal Poultry Farm (Partnership firm, in which Sh. Lajpat Rai was also one of the partner), which was further purchased by M/s Punjab Poultry Products (present firm), in which, Sh. Lajpat Rai sole proprietor of the farm. No addition of poultry shed had been done since its originally purchased in 2010. However, the land area of 2 kanal was newly added for plantation purposes in year 2019. Presently, the poultry farm is running in total area of land 19 kanal 18 marla with same shed & birds capacity at which, it was originally purchased. Poultry sheds are located at a distance of 25 mtr from the rural road/pagdandi and the boundary wall of the farm. As such, it is complying with the guidelines prescribed by the CPCB.
In view of above, it is recommended that consent to operate under the Water Act, 1974 and the Air Act, 1981 may be granted to the poultry farm upto 31.12.2029 with usual conditions and special condition that it will regularly complying with the guidelines/SOPs prepared by the CPCB.
