It is submitted that the industry is a small scale orange category rice sheller and was granted consent to establish/NOC from the Board under the Water Act, 1974 and the Air Act, 1981 vide no. CTE/Fresh/BAR/2023/22831219 dated 11/08/2023 valid upto 10/08/2024 for manufacturing of Sorted Raw Rice with Dryer @ 2.0 TPH by processing of Paddy @ 3.0 TPH, as raw material under orange category.
Now, the industry has applied for obtaining fresh consents under the Water Act, 1974 and under the Air Act, 1981 for same production i.e. manufacturing of Sorted Raw Rice (with dryer) 2.0 TPH by processing of Paddy @ 3.0 TPH, as raw material.
The rice sheller has deposited Rs. 52,500/- (Rs. 50,400/- as consent fee + Rs. 2100/- penalty fee) vide no. 995149101 dated 22.03.2024 under the Water Act, 1974 and Rs. 53,000/- (Rs. 50,400/- as consent fee + Rs. 2100/- penalty fee + Rs. 500/- application fee) vide no. 975473152 dated 22.03.2024 under the Air Act, 1981. The industry has submitted the CA certificated for the value of fixed assets Rs. 147.16 Lacs as on 13.03.2024. The fee deposited by the industry is adequate upto 30.09.2029 under the Water Act, 1974 and the Air Act, 1981.
The industry has submitted an undertaking regarding the APCDs installed by the industry. The industry has also submitted compliance report of previous consent conditions earlier granted to it for setting up a rice sheller unit.
The rice sheller has submitted approved building plan duly approved by Competent Person approved under Factory Act, 1948.
To verify the compliance of consent conditions earlier granted to the rice sheller & the code of practice, the rice sheller was visited by undersigned on 28/03/2024 and it was observed as under : -
1. The industry was in operation during visit.
2. The industry has covered all the processing sheds.
3. The industry has installed cyclone as APCD for shelling section but not provided platform and sampling arrangements with the same.
4. The industry has not installed APCD with dryer section.
5. The industry has provided brick wall of approx. 6-7 feet height in front of the discharge point of rice husk area which is of in-adequate height and also not provided net of height 5 ft above this wall.
6. The industry has no source of trade effluent generation.
7. The industry has constructed soakage pit for domestic effluent of the toilet section.
8. The industry has planted sapling of trees along the boundary wall.
9. The industry has not provided stabilized/paved movement area.
Thereafter, the rice sheller was issued show cause notice for refusal of consent to operate under the Water Act, 1974 and the Air Act, 1981 vide letter no. 1405 dated 01.04.2024 with an opportunity of personal hearing before EE, RO, Sangrur on 16.04.2024.
Further, Sh. Gagandeep, Partner, appeared before Environmental Engineer, Regional Office, Sangrur on 16.04.2024 and informed that the industry has provided platform and sampling arrangements with APCD and also provided APCD with dryer section with stack of adequate height. The industry has provided wall of 10 feet of mild steel and net of 5 feet above the wall in front of discharge point of rice husk. The industry has also constructed septic tank for disposal of domestic effluent. He further informed that the work of stabilizing movement area has started at site and will be completed within two months. He produced photographs representing compliance made by the industry.
After hearing the representative of the industry and officer of the Board, following decisions were made:
Assistant Environmental Engineer-I, Regional Office, Sangrur shall visit the industry within 07 days, to verify contentions made by the industry during hearing, and submit fresh recommendations in the matter to decide the consent applications on merits.
The proceedings of the personal hearing has also been conveyed to the industry vide this office letter no. 2255 dated 03.05.2024.
Further, the industry has been visited on 06.05.2024 and found that the industry has now provided platform and sampling arrangements with APCD of shelling section. The industry has also installed APCD with dryer section. The industry has now provided MS sheet wall of height 15 feet. The industry has provided septic tank for disposal of domestic effluent onto land for plantation. The soil compaction has been done at site and industry has started the work for stabilizing the movement area of vehicles with bricks and representative informed that it will complete within two month.
In view of above, it is recommended that consent to operate granted under the Water Act, 1974 & the Air Act, 1981 may both be granted upto 30/09/2029 (upto adequacy of fee) for manufacturing of Sorted Raw Rice (with dryer) 2.0 TPH by processing of Paddy @ 3.0 TPH, as raw material under orange category, with suitable conditions and special condition that the industry shall got analyzed its stack emission samples from Board’s lab within one month and shall provide paved road on movement area of vehicles within two month and shall submit the report of the same in this office.
