Subject: Proceedings of the personal hearing given to M/s Walia Industrial Engineering Components, 313, Industrial area, Phase-9, Mohali w.r.t SCN for refusal of consent to operate applied under the Water Act, 1974 and the Air Act, 1981 before the Senior Environmental Engineer (P) of the Board on 6/5/2024

The officers of the Board brought out that the industry has now applied fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 without obtaining NOC of the Board for manufacturing of Automobile Parts @ 2000 No./day alongwith requisite documents.
The site of the industry was visited by officer of the Board on 19/4/2023 and it was observed as under:
1) The industry was in operation during the visit and engaged in manufacturing of auto parts.
2) The industry is also engaged in metal surface treatment process, wastewater generated from the process is being discharging directly into sewer without any treatment.
3) The industry is also having powder coating process equipped with inbuilt filters in a closed booth. The filters is being cleaned inside the booth and reuse the material.
4) The industry has installed phosphating section the same was yet not commissioned. The industry has installed ETP consist of Mixer Tank and Sand Filter for treatment of wastewater. The representative was apprised by the visiting officer about the operation of CETP, Chanalon for treatment of effluent and he informed that due to non-operation of CETP in the month of September – October 2024 they have installed the ETP.
5) The industry has installed one no. sand blast furnace in its premises and same was not in operation.
6) The industry has installed one DG set of capacity 160 KVA with canopy and stack of inadequate height.
The industry is violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981, willfully causing pollution in the vicinity, thus violating the provisions of the said Acts, intentionally and deliberately. It was proposed to refuse the consent to operate applied under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, after affording an opportunity of show cause-cum-personal hearing.
Therefore, the industry was served show cause notice refusal of consent to operate applied under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 vide no. 544-45 dated 26/4/2024 alongwith an opportunity of personal hearing before the Senior Environmental Engineer (ZP-1) of the Board on 6/5/2024.
The representative of the industry attended the hearing and submitted authority letter as well as reply of show cause notice which were taken on record. The reply submitted by the industry was found not satisfactory. The industry has not obtained consent to establish (NOC) from the Board and commissioned its unit without obtaining consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 and causing pollution in the area.
After hearing the representative of the industry and officer of the Board, the Senior Environmental Engineer (ZP-1) of the Board decided that:
1) The consent to operate applied by the industry under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 be refused.
2) Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar may be asked to initiate the action against the industry u/s 33-A of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 for its closure.
If approved, proceedings of the personal hearing as above may be conveyed to the industry and Environmental Engineer, PPCB, RO, SAS Nagar for compliance and sending the report, respectively.
