It is submitted that the applicant has proposed to establish a small-scale drinking water packaging unit under Green category. Accordingly, the industry has applied for obtaining Consent to Establish (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for Flavoured Carbonated Water @ 4 KLD and Packaged Mineral Water @ 36 KLD by using Carbon Dioxide Gas @ 5 Kg/Day, Sugar @ 10 Kg/Day, Jeera & Other Flavours @ 2 Kg/Day, Ground Water @ 45 KLD as raw material with requisite documents and NOC fee.
The industry has submitted the sale deed dated 27/10/2023 executed between Sh. Jaswant Singh S/o Sh. Ajaib Singh, R/o House No. 24, Ward No. 1, Jhungian Road, Kharar, District SAS Nagar and M/s Aggar Industries Private Limited of Khewat Khatoni No. 51/57, Hadbast No. 212, Khasra No. 9//14/2/1(0-18), 9//15/1 (1-12), 9//16/1 (3-12), 9//7/1/1 (1-13), 10//20/1 (0-5) of total land area 8 Kanal 0 Marle in the revenue estate of Village Shergarh Bara, Tehsil Bassi Pathana, District Fatehgarh Sahib. Further, the industry has submitted the certificate of In Principal Approval issued by DC Fatehgarh Sahib vide no. 32 dated 03/01/2024 under Punjab Right to Business Act, 2020 and as per condition no (vi) of certificate, it has been stated that during the course of validity of certificate of in principle approval, the enterprise shall at any time but no later than three years and six months from the date of issue of the certificate, apply and obtain all application regular approval from the concerned department through the single window system of Punjab Bureau of Investment Promotions (PBIP).
The industry has submitted the certificate issued by the Tehsildar, Bassi Pathana alongwith the application and as per the said certificate, the distance of the proposed site from the various landmarks as mentioned in the Consent Management Policy of the Board dated 30/04/2013 are as under:

4 ਰਕਬੇ ਦੇ 100 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿੱਚ 15 ਪੱਕੇ ਰਿਹਾਇਸ਼ੀ ਮਕਾਨ ਨਹੀਂ ਹਨ। ਨਹੀਂ ਹਨ
Further, the applicant has also submitted an undertaking (attached herewith), wherein, it has mentioned that the industry will keep the sufficient distance from Lal Lakir/Phirni of nearest village and will not carry out any manufacturing activity within this specified area.
The industry has submitted the brief project report, wherein, it has mentioned that the total cost of the project is Rs. 455.50 lacs with value of plant & machinery is Rs. 270.00 lacs. Accordingly, the industry has deposited NOC fee amounting to Rs. 8400/- vide online R. no. 678373429 dated 28/02/2024, which is adequate for 01 year as per Board's Office Order dated 29/10/2018.
The industry has submitted the feasibility report, wherein, it has mentioned that the unit has proposed to install LPG fired stove with adequate stack height. Further, it has proposed to install DG set of capacity 250 KVA with canopy and stack of adequate height. The industry has proposed to install RO plant. The RO permeate to the tune of 36 KLD will be used as Packaged Mineral water for bottling & 4 KLD of flavored carbonated water to be bottled. The RO reject will be utilized onto land for plantation ensuring that the concentration of the TDS in the RO reject will not be increase beyond 2100 mg/l. The industry has proposed to develop the plantation in an area of about 3.5 kanal. The industry has also proposed to reuse the RO reject in dual plumbing system.
To verify the contents of the application, the site was visited by the undersigned on 02/05/2024. During the visit, it was observed as under:
1. The proposed site falls in the revenue estate of Village Shergarh Bara, Tehsil Bassi Pathana, District Fatehgarh Sahib.
2. The industry has started the work of constructing boundary walls.
3. No plant & machinery has been installed at the site.
Site Suitablitiy:
The industry has submitted the certificate of In Principal Approval issued by DC Fatehgarh Sahib vide no. 32 dated 03/01/2024 under Punjab Right to Business Act, 2020 and as per condition no (vi) of certificate, it has been stated that during the course of validity of certificate of in principle approval, the enterprise shall at any time but no later than three years and six months from the date of issue of the certificate, apply and obtain all application regular approval from the concerned department through the single window system of Punjab Bureau of Investment Promotions (PBIP). Further, the Tehsildar has also submitted the certificate as mentioned above and as per the said certificate, the proposed site is conforming to the general siting guidelines prescribed by the Board for establishment of such type of units.
Applicability of EIA notification dated 14/9/2006 and Applicability of first schedule of Factories Act, 1948:

It is submitted that the Govt. of India, Ministry of Jal Shakti, Deptt. of Water Resources RD&GR Central Ground Water Authority, New Delhi has issued directions u/s 5 of Environment (Protection) Act, 1986 vide letter no. CGWA- 21/6/2020-CGWA-101 dated 06/04/2022 “that it shall be mandatory for the Project Proponent abstracting ground water to obtain NOC from CGWA or the concerned State/ UT Ground Water Authority as the case made be in the compliance condition in consent to operate and consent to establish issued by the State Pollution Control Board.” Accordingly, the Board vide letter no. 1955-57 dated 18/01/2023 has informed all the officers of the Board in continuation to earlier circular no. CEE(HQ)/2018/7956-84 dated 03/03/2018 and 768-97 dated 13/01/2021 to ensure the compliance of the said directions.
PWRDA vide notification dated 27.01.2023 has exempted units from obtaining any permission of the authority, which are extracting not more than 300 cubic meters of ground water per month.
In the subject cited case, the industry has mentioned ground water extraction @ 48 KLD. Considering 25 working days per month, ground water extraction will be 1200 KL/month, which is more than 300 KL/month. As such, the industry requires to obtain permission from PWRDA.
In view of the facts mentioned above, if approved, the Consent to Establish (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for Flavoured Carbonated Water @ 4 KLD and Packaged Mineral Water @ 36 KLD by using Carbon Dioxide Gas @ 5 Kg/Day, Sugar @ 10 Kg/Day, Jeera & Other Flavours @ 2 Kg/Day, Ground Water @ 45 KLD as raw material may be granted for one year with suitable conditions and following special conditions:
1. The project proponent shall establish its unit in the land details mentioned in the sale deed and certificate issued by the Tehsildar, Bassi Pathana.
2. The industry shall develop adequate plantation area for utilization of the RO reject and ensure that the concentration of TDS in the RO reject does not increase beyond 2100 mg/l.
3. The industry will ensure that its industrial shed will be located more than 100 meters away from the phirni/lal lakir of the nearest village. Furthermore, no manufacturing activities are permitted within this 100-meter radius. Non-compliance with this condition will result in the automatic cancellation of the Consent to Establish (NOC) from an environmental perspective. In such an event, the Board will not bear any financial liabilities that may arise due to the cancellation of this NOC.
4. The unit shall obtain fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 before commissioning of the unit.
5. The industry shall submit permission regarding ground water abstraction from PWRDA at the time of obtaining consent to operate.
6. The industry shall get the building plan approved from the Competent Authority and submit the same at the time of obtaining consent to operate.
