It is submitted that the industry has applied for obtaining fresh consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for establishment of manufacturing unit for manufacturing of Casting of mould boxes @ 4200 number/year by using raw material Steel scrap @ 4254.432 MT/Year, Foundry return @ 2277.600 MT/Year, Additives @ 262.080 MT/Year alongwith requisite documents. The industry has deposited Rs. 18500/- vide UTR No. N071242928520258 dated 11.03.2024 as NOC fee. The fee deposited by the industry is adequate for one year against the total proposed cost of the industry Rs. 596.4 lacs. The industry has submitted a copy of letter issued by Department of Town and Country Planning, Punjab vide memo no. 2118 dated 27.09.2012 regarding change of land use for the land for M/s Shine Metal Tech. Pvt. Ltd., Village Raje Majra (H.B. No. 192), Tehsil & District Roop Nagar from Agricultural to Industrial purpose. The industry has submitted a copy of letter issued by Punjab State Council for Science & Technology vide ref. no. PSCST/TFD/665 dated 25.01.2024 for feasibility Report- Containment-cum-Air Pollution Control System for induction Furnace, in which, it has been mentioned that: “Reference to your request letter dated 19.1.2024 on the subject cited above. Please find enclosed herewith one set of revised feasibility report for Air Pollution Control Devices for new induction furnace having melting capacity as 1 T/heat. This supersedes the earlier feasibility report sent vide our letter no. PSCST/TFD/576 dated 4.1.24. You are requested to implement the proposed system in a time bound manner. The validity of our consultancy is up to one year from the date of issue of earlier feasibility report. In case any query, please feel free to contact us.” The industry has submitted point wise reply to the observations for which earlier application was returned and same is given as under: S. No. Observations Reply 1. The name of the industry is not complete in many documents. The same has been checked and documents with complete name have been attached along the application form. 2. The solid waste details not mentioned. The details of solid waste have now been entered in the application and also in the feasibility report attached along the application. 3. The SAC permission is not submitted. The capacity of induction furnace is 0.45 TPH and for the induction furnace of the such capacity, SAC approval is not applicable. 4. The report of Tehsildar regarding distance from various parameters not submitted. The requisite report from the revenue authorities has been obtained vide DC, Rupnagar Office letter no. 6771 dated 15.05.2012 and the same is enclosed along the application form. 5. Following documents are not submitted: a. Authority letter. b. Appropriate project report authenticated by CA. The documents i.e. Authority letter as well as Detailed Project Report (DPR) both are attached along the application form. The industry has submitted rent deed executed on 9th September, 2021 between M/s Shine Metaltech Pvt. Ltd. at Village Rajemajra, NH-21, Kurali Ropar Road, Near Toll Plaza, District Ropar-140108, Punjab (“Landlord”) and M/s Gilco India Private Limited at Village Rajemajra, NH-21, Kurali Ropar Road, Near Toll Plaza, District Ropar-140108, Punjab (“Tenat”). The industry has submitted rent deed executed on 21.03.2024 for additional land area 9200 sq.feet between M/s Shine Metaltech Pvt. Ltd. at Village Rajemajra, NH-21, Kurali Ropar Road, Near Toll Plaza, District Ropar-140108, Punjab (“Landlord”) and M/s Gilco India Private Limited at Village Rajemajra, NH-21, Kurali Ropar Road, Near Toll Plaza, District Ropar-140108, Punjab (“Tenant”). The industry has submitted building plan approved by Er. Adarsh Vig Gupta, Competent Person approved by Director of Factories, Punjab. The site of the industry was visited by the undersigned on 06.05.2024. During the visit, it was observed as under: 1. The industry is being established in premises of M/s Shine Metaltech Pvt. Ltd. is separated by wall. 2. The installation of induction furnace of capacity 0.45 T/heat is under progress. 3. The industry has installed canopy hood with elliptical cut followed by spark arrester and pulsejet bag filter house alongwith stack of height 3 m above top of shed (49 ft) as per design of feasibility report of PSCST, Chandigarh. 4. The industry has installed sand plant for mould manufacturing. 5. The industry has proposed to install 02 no. shot blasting machines. 6. No trade effluent will be generated. 7. Toilets etc. of M/s Shine Metaltech Pvt. Ltd. will be used. 8. DG set of M/s Shine Metaltech Pvt. Ltd. will be used 400 KVA & 250 KVA both with canopy & stack of adequate height. It is further submitted that the Foundries (ferrous and non-ferrous) — Castings and forgings including cleaning or smoothening/roughening by sand and shot blasting, in non-industrial zone requires SAC clearance. However, the Director of Factories vide no. 11593-615 dated 28.11.2005 has exempted furnaces of capacity upto 500 kg/heat from obtaining site approval from SAC. In view of the above, it is recommended that consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted for one year subject to suitable conditions and following additional conditions that: 1. The industry shall not install induction furnace of capacity more than 500 kg/heat without obtaining site approval from SAC under Factories Act, 1948. 2. The industry shall not install any shot blasting machines without obtaining site approval from SAC under Factories Act, 1948 and shall get the job done (shot blasting) from any other authorized vendor / industry. 3. The industry shall comply with the conditions mentioned in the letter no. 11593-615 dated 28.11.2005 issued by Director of Factories, Punjab. 4. The industry shall not start any other new process within its unit which may change its category from Orange to Red, without the prior written permission of the Board. 5. The industry shall obtain permission from other concern departments, if need be. 6. The industry will stick to the production capacity viz-a-viz discharge mentioned in this consent and will not increase the same without the prior written permission of the Board. 7. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain/ inland surface waters/ drain/ choe/ nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 8. The industry shall ensure that no problem related to pollution is being caused by the unit due to its operation and no public complaints are received by the Board in this regard. 9. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 10. The industry shall obtain authorization of the Board under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. 11. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, the Air (Prevention & Control of Pollution) Act, 1981, the Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time. 12. This consent to operate is being issued to the industry based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry/ project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing.
