It is submitted that earlier, the workshop was issued notice for violation of the provisions of Water (prevention & Control of Pollution) Act, 1974 with an opportunity of personal hearing before the Senior Environmental Engineer, Zonal office-1, Ludhiana on 20.10.2020 in which following decisions were taken:-
1. The industry shall complete the work of installation and commissioning of the ETP to treat the effluent, within 01 month.
2. The industry shall submit the certificate regarding land use patter of the site of the area within 15 days.
3. The industry shall apply for obtaining consent to operate under the Water (prevention & Control of Pollution) Act, 1974 and Air (prevention & Control of Pollution) Act, 1981 within 15 days.
4. The Environmental Engineer, Regional Office-II, Ludhiana shall visit the industry and submit the report in the matter within 15 days.
Now, it has closed its washing and painting process permanently and now workshop falls in Small Scale, Green category. It has applied for fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 alongwith documents and fee under Green Category.
The workshop was visited by the AEE of this office on 08.05.2024 and observed as under:-
1. The workshop was in operation and now engaged in the process of repairing of vehicles only.
2. The washing section and its effluent treatment facility was lying in dismantled condition.
3. The workshop had submitted its under taking that workshop is not being carried out any water or air polluting process (i.e. Washing, painting etc.) in its premises and the same will not be carried out without the written permission of the Board.
4. Hence, there is no source of trade effluent and domestic effluent is discharged into sewer.
5. The workshop is having a submersible pump.
6. The service station has provided DG set of capacity 35 KVA with canopy & adequate stack height.
7. The land of the workshop is on rent and rent deed is valid upto 05.01.2032.
8. The industry has submitted the letter issued by DTP, Ludhiana vide no. 796 DTP (L)/M2-A dated 03.04.2024 vide which the site of the workshop falls within the Municipal limits of Sahnewal and Mix Land Use aalang Road Front Zone as per approved Master Plan, Ludhiana (2007-31).
9. As per Department of Town and Country Planning Punjab, Notification -regarding Uniformity in the zoning regulations of the State of Punjab issued vide No. 6515-41 dated 18.10.2018 (copy attached) Showroom and workshop including painting & washing of heavy motor vehicle (HMV) such as Buses, Trucks and other heavy vehicles
are permissible in this zone.
10. As per electricity bill the date of commissioning of the workshop is 01.11.2012.
11. The workshop has deposited the consent fee as under:-

The consent fee deposited by the workshop is adequate upto 31.12.2029.
Keeping in view of the above, it is recommended that consent to operate under Water (Prevention & Control of Pollution) Act, 1974 may be granted to the industry upto 31.12.2029 with usual condition and with the special condition that :-
1. The PP shall not carry out the Water or Air Polluting process (i.e. Washing/Painting in its premises without written permission of the Board).
2. The PP shall comply with the provisions of the Department of Town and Country Planning Punjab, Notification -regarding Uniformity in the zoning regulations of the State of Punjab issued vide No. 6515-41 dated 18.10.2018 and issued from time to time.
