It is submitted that school has submitted the reply of the show cause notice vide its letter dated 15.04.2024, in which it is stated that society M/s Technical Education College, Barnala had been registered in 2001 and also building for the technical college had been constructed in 2001 in land area 25 kanal 9 marle bearing khasra no. 296//9/2 (7-18), 296//10 (7-16), 297//5/2 (4-9), 297//6 (5-6). And, technical college was running from 2004 to 2015. Moreover the submission regarding establishment of the premises in 2004 is also acknowledged by DTP Vide letter no. 651 DTP(S)/SS-130 dated 10.07.2019 After that, technical college was converted to school in the year 2016 (proof attached- electricity bill, power load increased) and affiliation certificate in the same land area 25 kanal 9 marle and no addition of land area/building has been constructed. Only renovation work has been done. There was no any change in land and building in process to convert the college to school which is running successfully from the 2001. There was a notification of 2008 which mentions that there should not be any kind of polluting industry within the radius of 100 meters from the educational institute. But this notification does not apply in our case as our educational institute has been running since 2004.
The school has also submitted the balance consent fee of Rs. 71,200/- vide no. 582648932 dated 08.05.2024 under the Water Act, 1974 and Rs. 71,200/- vide no. 340371354 dated 08.05.2024 under the Air Act, 1981. The fees has been deposited upto 31.03.2022 as per CA certificate of amount 4.99 crore and fee from 01.04.2022 to 30.09.2033 as per CA certificate of amount 5.36 crore. The fee deposited by the school is adequate upto 30.09.2033. Further, as per the documents submitted by the school (DTP certificate and copy of registry), the area of earlier college and present school is same i.e 25 kanal 9 marle and there is no addition in the land.
Keeping in view of above, reply of the school, if approved, it is recommended that consent to operate under the Water Act, 1974 and the Air Act, 1981 may be granted to the school upto 30.09.2033 (upto adequacy of fee) with usual conditions.
