It is submitted that the subject site industry has obtained consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/FGS/2021/16079067 dated 13/07/2021 and the Air (Prevention & Control of Pollution)Act, 1981 videno. CTOA/Fresh/FGS/2021/16075780 dated 13/07/2021, both were valid upto12/01/2022 for manufacturing of Thread take up level @ 2500nos./day subject to the suitable terms & conditions mentioned therein.
Now, the industry has applied for obtaining varied consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 as the industry has increased its manpower due to which the consumption of fresh water increased along with the same production capacity.
As per the record file, the fee deposited by the industry under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act,1981was adequate upto 31/05/2026. Now, the industry has submitted the CA certificate dated 09/02/2024, wherein, it has mentioned that the total value of fixed assets of the industry as on 31/03/2023 is Rs. 80.00 lacs with value of plant & machinery is Rs. 66.00 lacs. Accordingly, the industry has deposited consent fee amounting to Rs.28,000/-vide online R. No.475941730 dated 06/01/2024 under the Water Act, 1974 and Rs.28,000/-vide online R. No. 568806861 dated 06/01/2024 under the Air Act, 1981. The industry has also deposited Rs. 1800/- as NOC regularization fee for increase in cost of fixed assets of the industry. As such, the fee deposited by the industry under the both Acts is adequate upto 31/12/2026 as per Board's office order dated 29/10/2018.
The industry has submitted the building plan approved from the Competent Person, approved under Punjab Factory Act on 05/04/2024.
To verify the contents of the application, the industry was visited by Er.Pritpal Kaur, AEE on 02/05/2024 and during visit, it was observed as under:
1. The industry was in operation and engaged in the business of manufacturing sewing machine parts.
2. The industry has installed 2 no. electric heating furnace, 2 no. forging press, 3 no. framing press, Drill machines, Lathe machine and 01 no. electric annealing furnace.
3. The industry has provided drum wash facility for metal surface polishing using caustic soda.
4. The industry is re-using the caustic solution and has entered into an agreement with TSDF (attached herewith), Nimbua for lifting of sludge generated from the spent caustic as per the agreement dated 22/06/2021.
5. There is no wastewater generation from the caustic washing as the same is being recirculated and re-used after adding make up water and caustic solution.
6. The industry is also engaged in pickling process using sulphuric acid. The wastewater is being collected in collection tank (3 compartments) and the same is being lifted to M/s JBR Technologies Ltd. Unit-II as per the agreement dated 14/6/2021 for lifting of spent acid @ 1200 ltr/month.
7. The industry has provided water meter at the outlet of fresh water consumption.
8. The industry has maintained the record regarding fresh water consumption and wastewater lifted to M/s JBR Technologies.
9. The industry has provided septic tank for the treatment of domestic wastewater and the same is being disposed off onto land for plantation after passing through septic tanks.
10. The industry has installed 1 no. DG set of capacity 62 KVA, which is equipped with canopy and stack of adequate height.
It is submitted that the Govt. of India, Ministry of Jal Shakti, Deptt. of Water Resources RD&GR Central Ground Water Authority, New Delhi has issued directions u/s 5 of Environment (Protection) Act, 1986 vide letter no. CGWA-21/6/2020-CGWA-101 dated 06/04/2022“that it shall be mandatory for the Project Proponent abstracting ground water to obtain NOC from CGWA or the concerned State/UT Ground Water Authority as the case made be in the compliance condition in consent to operate and consent to establish issued by the State Pollution Control Board.” Accordingly, the Board vide letter no. 1955-57 dated 18/01/2023 has informed all the officers of the Board in continuation to earlier circular no. CEE(HQ)/2018/7956-84 dated 03/03/2018 and 768-97 dated 13/01/2021 to ensure the compliance of the said directions.
PWRDA vide notification dated 27.01.2023 has exempted units from obtaining any permission of the authority, which are extracting not more than 300 cubic meters of ground water per month.
In the subject cited case, the industry has mentioned ground water extraction @6 KLD. Considering 25 working days per month, groundwater extraction wills be150 KL/month, which is less than 300 KL/month. As such, the industry does note requires permission from PWRDA
.
In view of the facts mentioned above, If approved, it is recommended that the varied consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Thread take up level @ 2500 nos./day may be granted upto 30/09/2026 with suitable conditions and additional conditions that:
1. The industry shall lift its entire untreated trade effluent generated from pickling section to CETP operator i.e. M/s JBR Technology Ltd. Unit-II on regular basis and will not discharge the same in illegal manner.
2. The industry shall maintain the record regarding fresh water used in the process as well as untreated effluent lifted by CETP operator on regular basis.
3. The industry will not install any additional air polluting source without obtaining prior written permission of the Board.
4., The industry shall be bound to shift its unit from present location to designated area within the stipulated period as per the provisions of the notified Master Plan of Bassi Pathana, if need be.
