Sub: Proceeding of the personal hearing given before the Chief Environmental Engineer, Ludhiana on 09.05.2024 w.r.t show cause notice for refusal of consent to operate under the Air Act, 1981 to M/s Kaursain Spinners Ltd, Village - Arraincha, Po- Doraha, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry was granted consent to operate under the Air Act, 1981 vide no. CTOA/Renewal/LDH1/ 2023/ 23687631dated 28/11/2023 valid upto 31/03/2024 for manufacturing of Cotton/Polyester yarn @ 36.250 MTD & Cotton/Polyester yarn @ 7 MTD with special condition that the industry shall submit analysis report of ambient air emissions, within one month.
The industry has applied for obtaining renewal of consent to operate under the Air (Prevention & Control of Pollution) Act, 1981.
The industry was visited by officer of the Board on 19.03.2024 and it was observed as under:
1. The industry was in operation and both the spinning sections were in operation.
2. It is engaged in manufacturing of Cotton/Polyester yarn & Cotton/Polyester yarn by using raw material as Cotton /Polyester.
3. It has installed machinery for spinning of Cotton/polyester into yarn.
4. The industry has installed 03 DG sets of capacity 1000 KVA, 1250 KVA & 1500 KVA with canopies and adequate stack heights.
5. During visit, ambient air sampling was conducted by Board’s lab and as per analysis report, PM10 is reported as 316 ug/m3 near main gate (direction from which wind is blowing) and 335 ug/m3 near store (direction towards which wind is blowing). As per national ambient air quality standards notification dated 18.11.2009, permitted concentration of PM10 in industrial, residential, rural and other area is 100 ug/m3. The industry falls in Industrial zone outside Municipal Council limits and is violating the national ambient air quality standard.
In view of above, show cause notice for refusal of consent to operate under the Air Act, 1981 was issued to industry with hearing before the CEE, Ludhiana on 09.05.2024.
Sh. Pardeep Patra, G.M of the industry attended the hearing and submitted written reply which has been taken on record. He submitted that their industry is a spinning orange category unit and process is cotton/polyester into yarn. They are complying with the condition of consent to operate granted under the Air Act, 1981 valid up to 31.03.2024. He submitted that ambient air sampling was conducted on dated 19.03.2024 at 3.30 pm and analysis report PM10 is reported as 316ug/m near main gate and 335 ug/m3 near store. But, in that period of ambient air sampling our industry (orange category) has been completely stopped due to power cut and generator set running for lighting purpose. He further requested for re-sampling the ambient air sampling.
After hearing the officer of the Board and considering background of the case and material facts on the record, the Chief Environmental Engineer of the Board decided as under:-
1. The industry shall operate its APCD regularly and efficiently to achieve ambient air quality standards.
2. The Environmental Engineer, Regional Office shall verify submissions of industry, conduct ambient air sampling again and send further recommendations in the matter.
