Subject: - Proceedings of the personal hearing given to M/s Hans Enclave, Near Saffron Hotel & Restaurant Mansa Road, Bhikhi, Distt. Mansa before refusal of 'Consent to Establish' (NOC) under the provisions of the Water Act, 1974 & Air Act, 1981 by the Senior Environmental Engineer on 08.05.2024.............

It was brought out that the project proponent has applied for obtaining 'Consent to Establish' (NOC) under the Water Act, 1974 & Air Act, 1981 for establishment of residential colony in an area of 82 kanals 10 Marla's (10.3125 acres) for development of 102 no. residential plots, 17 commercial plots, 01 no. EWS& 01 no. School...............
From the perusal of the documents submitted by the project proponent, it has been observed that:-..............
1. The project proponent has failed to submit approved layout plan from the Competent Authority..............
2. STP of 80 KLD capacity has been proposed considering only 5 persons/plot, however as per the Department of Housing and Urban Development notification issued vide no. G.S.R. 144/P.A.11/1995/Ss.180 and 43/2021 dated 31.08.2021 circulated by the Board vide Head Office letter no. 15864-82 dated 22.07.2022, it has been specified that the population of plotted development shall be counted @ 15 persons per plot, hence the calculation of water pollution load as well as the disposal arrangements proposed by the project proponent are not adequate...............
In view of above, show cause notice before refusal of 'Consent to Establish' (NOC) under the provisions of the Water Act, 1974 and Air Act, 1981 issued to the project proponent alongwith an opportunity of personal hearing before the Senior Environmental Engineer on 08.05.2024............
During hearing, Sh. Gurpreet Singh, Representative attended the hearing and submitted written reply to the show cause notice issued to it, which has been taken on record. He further stated that the layout plan has yet not been approved by the concerned Competent Authority. He further submitted that the project proponent shall provide 15 meter green belt outside its premises for discharge of treated waste water @ 120 KLD, however failed to submit the registered land deed in the matter...............
During hearing, it was deliberated that the project proponent has failed to submit the approved layout plan from the concerned Competent Authority and has also failed to provide registered land deed of the adjoining land area for adequate disposal of the treated waste water considering 15 persons/plot as per the Department of Housing and Urban Development notification issued vide no. G.S.R. 144/P.A.11/1995/Ss.180 and 43/2021 dated 31.08.2021.................
After hearing the representative of the colony as well as officer of the Board, it has been decided by the Senior Environmental Engineer of the Board that the application applied by the project proponent for obtaining 'consent to establish' (NOC) under the provisions of the Water Act, 1974 & Air Act, 1981 be refused................
