It is submitted that earlier the industry was granted "Consent to Establish"(NOC) for an industrial unit u/s 25 of Water (Prevention & Control of Pollution) Act, 1974 and u/s 21 of Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2021/15836640 dated 24.06.2021, having validity upto 31.05.2022 for manufacturing of CI Casting @ 4800 MT/Year as product & Pig Iron (Scrap) Reuse for CI Casting @ 1200 MT/Year as by product by using Pig Iron and Scrap @ 6000 MT/Year Chemical (Nikel, Crome, Molly) @ 240 MT/Year as raw material with subject to suitable conditions mentioned therein.
Thereafter, the industry was granted extension in the validity of "Consent to Establish" (NOC) for an industrial unit u/s 25 of Water (Prevention & Control of Pollution) Act, 1974 and u/s 21 of Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Ext/SAS/2023/20712073 dated 16.01.2023, having validity upto 31.05.2023 with subject to suitable conditions mentioned therein.
Now, the industry has applied for obtaining fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of CI Casting @ 4800 MT/Year as product & Pig Iron (Scrap) Reuse for CI Casting @ 1200 MT/Year as by product by using Pig Iron and Scrap @ 6000 MT/Year, Chemical (Nikel, Crome, Molly) @ 240 MT/Year as raw material along with requisite documents and fee.
The industry has deposited Rs. 1,29,600/- vide UTR No. 35289979531DC dated 12.02.2024 under Water Act, 1974 & Rs. 21,600/- vide UTR No. 35290044031DC dated 12.02.2024 as penalty/late fee and Rs. 1,29,600/- vide UTR No. 35290015971DC dated 12.02.2024 under Air Act, 1981 & Rs. 21,600/- vide UTR No. 35290069661DC dated 12.02.2024 as penalty/late fee, against the total cost of fixed assets is Rs. 852.71 lacs as on 06.02.2024. The consent fee deposited by the industry is adequate upto 30.06.2030 under both acts.
The industry has submitted the certificate issued by PSCST vide no. PSCST/TFD/32 dated 25.04.2024, as per which: -
“Certified that M/s Shiva Metal Rolls, Village Behra, Gulabgarh Road, Derabassi, Punjab has installed Air Pollution Control Device of adequate capacity, for control of primary emissions, with their Induction Furnace having capacity as 4 Ton/Heat. This certificate is issued only for getting the “Consent to Operate” from Punjab Pollution Control Board. However, the final completion certificate will be issued after checking the performance of Air Pollution Control Device on operationalization of the furnace.”
The industry has submitted approved site plan prepared by Er. Adarsh Vir Gupta Competent Person from Director of Factories, Punjab.
The industry was visited by AEE of this office on 15.05.2024 and it was observed as under:
1) The industry was in operation during the visit.
2) The industry has installed 1 no. induction furnace of capacity 4.0 TPH with side hood followed by bag house filter as APCD, the industry has submitted completion certificate from PSCST vide no. PSCST/TFD/32 dated 25.04.2024
3) The industry has installed one annealing furnace in which LSHS is being used as fuel and provided with stack of adequate height.
4) The industry has installed various lathe machines for finishing purpose
5) The industry has installed one no. D.G set which is equipped with canopy and adequate stack height.
6) There is no source of trade effluent and domestic effluent is being discharged onto land for plantation after passing through septic tank.
In view of above, it is recommended that the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30.06.2029 with subject to suitable conditions and special conditions that:
1. The industry will comply with the SOP’s for such type of units as recommended by PSCST, Chandigarh.
2. The industry shall apply for obtaining authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, within one month.
3. The industry shall not generate and discharge any kind of trade effluent from its premises.
4. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation at any time, under any circumstances.
5. The industry shall ensure that due to operation of the project at the site, no nuisance for general public is created at any time and no public complaints are received.
6. The Consent is being granted to the industry based upon the undertaking/ documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
7. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
