It is submitted that the establishment is a poultry farm and is already in operation since Oct., 2020 for production of eggs by occupying Layer birds and manufacturing of poultry feed by using Maize, Bajra, Soya, Mustard etc. without obtaining consent to establish of the Board.
Now, the poultry farm has applied for fresh consents to operate under the Water Act, 1974 & the Air Act, 1981 for production of eggs @ 75000 nos./day by occupying Birds @ 80000 nos. and manufacturing of poultry feed @ 6.0 T/day by using Maize, Bajra, Soya, Mustard etc. @ 6.0 T/day, as raw material.
The poultry farm has deposited consents fee as mentioned at sr. no. (vii) against the gross fixed assets of value 24.51 lacs as on 31.03.2023 as per CA certificate dated 03.04.2023.
The Poultry farm has submitted the electricity bill as proof of commissioning w.e.f. Oct. 2020 and accordingly, the fee after after deducting NOC regularization and penalty fee under both the Acts, is being adjudged. In this way, the fee deposited by the poultry farm becomes adequate upto 31.03.2030 under both the Acts.
The poultry farm has submitted building plan from competent person approved from Director of Factories.
The poultry farm has submitted Tehsildar report vide letter no. 1270 dated 03.01.2023 as per which the site of the poultry farm falls in the revenue estate of Village Ugrahan, Chajjla, Sunam, wherein it is metioned that: -
1. There is no residential area and drinking water source/water works falls in the radius of 500 mtr of the site of the poultry farm.
2. No river, lake and canal falls in the radius of 200 mtr radius of the site of poultry farm.
3. There is no National highway falls in the 150-200 mtr radius of the site of poultry farm.
4. The state highway is falls in the radius of more than 100 mtr of the poultry farm.
5. No summer storage tanks falls within the radius of 100 mtr of the poultry farm.
To verify the fact of the poultry farm, the site of the poultry farm was visited by the officer of this office on 15.05.2024 and it was observed as under:-
1. The poultry farm located at Village Ugrahan, Tehsil Sunam and District Sangrur and was in operation.
2. The poultry farm is a layered poultry farm and has constructed 4 single story sheds.
3. There is no residential zone/houses, poultry/dairy, zoo sanctuary in the radius of 500 mtr from the site of the poultry farm. There is no any water body and national highway in the radius of 200 mtr, there is no drinking water source and state highway in the radius of 100 mtr from the site of the poultry farm. There is no rural road, internal road/village pagdandies in the radius of 15 mtr.
4. The Poultry sheds are also located more than 10 m from the approach road for cross ventilation and odour dispersion.
5. Hence, the site fulfil the criteria for the establishment of poultry farm at this location.
6. The poultry farm has provided the two deep burial pit with cover for the disposal of dead birds.
7. The birds littering is supplied to the farmers as manure as free of cost by the poultry farm. During visit, no flies were observed at site.
8. The poultry farm has own feed mill provided cyclone as APCD.
9. The poultry farm is generating domestic effluent @ 1.0 KLD which is discharged onto land for plantation after passing through septic tank.
10. The poultry farm is not generating trade effluent.
11. The poultry farm has installed one D.G set of capacity 32 KVA with canopy.
Further, it is also informed that this poultry farm is an existing poultry farm and was commissioned in October, 2020. The poultry farm is complying with the environmental compliance as well as sitting guidelines as prescribed by PPCB/ CPCB for such units.
As per modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 regarding harmonization of classification of industrial sectors under red, orange, green, white categories vide its letter dated 07.03.2016 along with the "Final documents on revised classification of industrial sectors under red, orange, green & white categories" which also includes the consent period for which the consents are to be granted to red, orange & green category industries for 05 years, 10 years & 15 years respectively.
No complaint is pending against the poultry farm. The poultry farm is complying with the Environmental Guidelines issued by the CPCB.
Keeping in view of above, it is recommended that varied consent to operate (CTO) under the Water Act, 1974 and the Air Act, 1981 may both be granted up to 31.12.2029, for the production of Eggs @ 75000 Numbers/Day and Poultry Feed @ 6.0 T/day by occupying Birds @ 80000 Numbers/Day and Maize, Soya, Mustard, Sun Flower, DOC, Bazra, Lime stone & GNE @ 6.0 T/day as raw material, subject to the suitable conditions and special condition that the poultry farm will comply with the Environmental Guidelines issued by the CPCB on regular basis in true spirit.
