Sub:- Application for obtaining Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974- M/s Randhawa BKO, Village- Basrai, P.O. Quadian, Tehsil-Batala, District-Gurdaspur.
The subject cited industry has applied for obtaining fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 through OCMMS mode. Earlier, the Brick Kiln was granted auto-renewal consent to operate Air (Prevention & Control of Pollution) Act, 1981 vide online reference no. CTO/Renewal/GRP/2024/25662253 dated 15/05/2024, which is valid upto 15/05/2029 under Orange Category.
The industry has deposited Rs. 31,100/- vide UTR No. 833000013 dated 15/05/2024 as consent to operate fee under Water (Prevention & Control of Pollution) Act, 1974, which is adequate upto 30/09/2029 including Rs. 500/- as Form downloading fee against total gross value of fixed assets worth Rs. 16,11,250.40/- as on 31/03/2024.
The industry has submitted completion certificate issued by PSCST, Chandigarh vide letter no. PSCST/CC/733 dated 15/11/2019 intimating that the industry has constructed induced draft Brick Kiln with zig-zag firing as per the technology evolved by the Punjab State Council for Science & Technology. The Kiln owner will ensure the implementation of recommended operating practices as per the Feasibility Report (SPL-1063). The Brick Kiln has also submitted the copy of dimensional drawing/plan of Kiln showing the length of Central Island of brick kiln is less than 245 ft.
As per policy of the Board and in the light of Head Office Order No. 59 dated 02/02/2016, the consent cases of Orange Category units are to be processed without visiting them.
In view of the above, may if approved “Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 may be granted to the industry for a period upto 30/09/2029 subject to the suitable conditions along with the special conditions as under:-
1. The project proponent shall comply with code of practice/directions issued by PSCST, Chandigarh.
2. The brick kiln will obtain Environmental Clearance under EIA notification for mining of brick clay to be used as a raw material for the manufacturing of bricks as per Head Office order no. 346 dated 1/8/2016.
3. The brick kiln shall get its stack emission analyzed as per policy of the Board.
4. The consent is subject to the orders passed by the Hon’ble High Court for the state of Punjab & Haryana/Hon’ble National Green Tribunal or other judiciary authority in the cases pending or being filed with regard to the subject matter of the office order.
5. The consent is subject to the performance evaluation of new technology adopted by the brick kiln.
6. The brick kiln will plant adequate trees around the boundary of the Brick Kiln and the domestic effluent will be treated in septic tank and treated effluent shall be discharged for irrigation of plantation.
7. The Brick Kiln shall use atleast 20% Paddy Straw Pellets as fuel with coal as per Board’s
notifications no. 10/574/2022-STE1/443 dated 04/11/2022.
