File Note: It is intimated that the poultry farm is a green category unit and engaged in the business of layered bird poultry farm having birds approx. 70,000 number and producing eggs. The poultry farm had applied consent to operate under the Water Act, 1974 and the Air Act, 1981 on 13/07/2023 and 04/11/2023 and both the applications were returned due to incompletions. Thereafter, the poultry farm has not applied for consent of the Board. Earlier, the poultry farm was issued SCN without hearing for violations of the Water Act, 1974 and Air Act, 1981 vide Zonal Office letter no. 1451 dated 03/05/2023 due to violation of the Water Act, 1974 and the Air Act, 1981 during visit on 05.01.2023, to explain its position in writing within 15 days from the date of issuance of this notice. A copy of the same is attached herewith for information. However, the poultry farm has neither applied for consents of the Board nor submitted any reply of the show cause notice. Therefore, the poultry farm was again visited by the officer of this office on 24.01.2024 and found that:- 1. The poultry farm is a layered poultry farm. 2. The poultry farm has provided the three deep burial pit for the disposal of dead birds outside the premises. One pit is closed, second pit was full of dead birds but not covered and the third pit was in use. All three pits are made temporary outside the poultry farm and were not covered with any kind of lid. 3. The birds littering is supplied to the farmers as manure. During visit, no flies were observed at site. Foul smell/odour was observed during visit. 4. The poultry farm has own feed mill of capacity 7.0 T/day without cyclone as APCD. 5. During visit, it is observed that the manure was in wet condition and some kind of waste like plastic bottles, polythenes and eggs are also found in birds litter collection. 6. The domestic effluent generated from poultry farm was being discharged directly on the land owned by the owner and during visit stagnation was found at site. Due to above said violations, a show cause notice was issued to the poultry farm for violating the provisions of the Water Act, 1974 and the Air Act, 1981 vide this office letter no. 528 dated 19.02.2024 with an opportunity of personal hearing before the Environmental Engineer, Regional Office, Sangrur on 22.02.2024. Sh. Raghav Sadiora, partner of the poultry farm appeared before Environmental Engineer, Regional Office, Sangrur on 22.02.2024 and after hearing following decisions were made :- 1. The poultry farm shall apply for obtaining consent to operate under the Water Act, 1974 and the Air Act, 1981 within 7 days after the operation of OCMMS portal of the Board. 2. Assistant Environmental Engineer-I, Regional Office, Sangrur shall visit the poultry farm after a week to verify contentions made by the poultry farm during hearing. The proceedings of said hearing has been conveyed to the industry vide letter no. 2268 dated 06.05.2024. Now, the poultry farm has applied for obtaining consent to operate under the Water Act, 1974 and the Air Act, 1981 for Eggs @ 56,000 Numbers/Day & Poultry Feed (For Self Consumption) @ 10 T/day by using Laying Birds @ 70,000 Numbers/Day & Maize, Soya, Mustard, Sun Flower, DOC, Bazra, Lime stine & GNE @ 10 T/day as raw material under small scale green category. The poultry farm has submitted electricity bill as the proof of date of commissioning, wherein the connection date is mentioned as 15.01.2019. The poultry farm had already deposited consent fee of Rs. 96,000/- vide no. CMS1602357571381 dated 10.06.2023 under the Water Act, 1974 and Rs. 96,000/- vide no. CMS1602357567040 dated 10.06.2023 under the Air Act, 1981. The poultry farm had also deposited Rs. 6400/- vide no. CMS1602357567041 dated 10.06.2023 as NOC fee, against the value of fixed assets of Rs. 168.70 lakh as per CA certificate dated 17.04.2024. The fee deposited by the poultry farm is adequate upto 14.01.2029 (after deducting penalty fee under both acts). The poultry farm has submitted Tehsildar report vide dated 06.10.2023, wherein it has been mentioned as under:- a) There is no residential houses in area of 500 mtr of the poultry farm. b) There is no lal lakir/phirni of village in area of 100 mtr. c) There is no 15 pucca houses in area of 200 mtr. d) There is no MC limit in area of 100 mtr. e) There is no water sources like river, lake and canal in area of 200 mtr. f) There is no water sources, river, summer water tank or any other tank in area of 100 mtr. g) There is no poultry farm, diary farm or any other industry in area of 500 mtr. h) There is no national Highway in 150-200 mtr. i) There is no state highway in 100 mtr. j) There is no rural road, internal road/village pagdandi in 10-15 mtr. The poultry farm has also obtained CLU from DTP, Barnala vide memo letter no. 200 -DTP(Barnala)/SS-130 dated 19.04.2023, as per which the site falls in Notified Local Planning Area, Barnala. The site falls in agricultural area as per draft master plan. There is a drain passing in front of the site. As per Zoning Regulations, the poultry farm shall provide 10 mtr green buffer zone with drain. The poultry farm has submitted partnership deed executed on 15.06.2022, as per which there are 03 no. partners running the poultry farm namely, Smt. Nirmal Sadiora w/o Sh. Rajesh Kumar Sadiora (50%), Sh. Rahul Kumar Sadiora s/o Sh. Rajesh Kumar Sadiora (25%) and Sh. Raghav Kumar Sadiora s/o Sh. Rajesh Kumar Sadiora (25%). The poultry farm has also submitted approved building plan duly signed by Competent Person approved under Punjab Factories Act. To verify the fact of the poultry farm, the site of the poultry farm was visited by the officer of this office on 07/05/2024 and it was observed as under:- 1. The poultry farm located at Village Khudi Kalan, Barnala and was in operation, during visit. The poultry farm is a layered poultry farm. Poultry farm has constructed 3 no. single story shed and one double story chick shed having total bird capacity of 70000. The poultry farm has provided nipple system for drinking purpose of birds. 2. The poultry farm has now provided the cyclone on its feed mill with adequate stack height. 3. The separate septic tank has been also provided for the treatment of domestic sewage. However, no proper plantation has been provided for the disposal of treated domestic effluent and excess cooling water. Same is being discharged into the adjoining plot for stagnation. 4. One rain water harvesting pit is also provided in the poultry farm, where surface water can also be discharged. The poultry farm is required to close the same. 5. The one concrete pit has been also provided for dead birds. 6. There is no approved residential zone, 15 pucca houses, poultry/dairy, zoo sanctuary in the radius of approx. 500 mtr from the site of the poultry farm. There is no any water body and national highway in the radius of approx. 200 mtr, there is no drinking water source and state highway in the radius of approx. 100 mtr from the site of the poultry farm. 7. There is a drain namely Lassara Drain carrying domestic sewage passes around at the distance of 50 mtr from the site. As per CLU issued by the DTP As per Zoning Regulations, the poultry is required to provide 10 mtr green buffer zone with drain, the plantation has been provided on the Govt. land by the concerned agency along the drain. However, the poultry farm has not provided the 10 mtr green buffer inside its premises towards drain. 8. The birds littering is supplied to the farmers as manure by the poultry farm. 9. The poultry farm is not generating any trade effluent. 10. The poultry farm has installed one D.G set of capacity 60 KVA with canopy. In view of above, it is recommended that consent to operate under the Water Act, 1974 and the Air Act, 1981 applied by the poultry farm be refused and action u/s 33-A of the Water Act, 1974 and 31-A of the Air Act, 1981 may be initiated against the poultry farm, please.
