Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 15.05.2024 w.r.t. show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 to M/s Ludhiana Metal Finishers,
St. No. 2, New Ram Nagar, Lohara Road, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is a small scale red category unit. The industry has applied for fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
The industry has submitted electricity bill as a proof of date of commissioning. The industry has submitted the letter issued by DTP, Ludhiana vide letter no. 3195 dated 26.10.2021 as per which the site falls in industrial mix zone as per Master Plan, Ludhiana (2007-31).
The site of industry was visited by officer of the Board on 13.4.2024 and it was observed as under:-
1. The industry was in operation during visit and engaged in pickling process on job basis.
2. The industry has signed agreement with M/s JBR Technology Pvt. Ltd., Ludhiana @ 5000 Ltr/M for the treatment & disposal of trade effluent generated from process.
3. Domestic effluent is being discharged into sewer.
The industry falls in industrial mix zone and has been commenced in 2021 i.e. after the commencement of Master Plan.
The industry was Show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 15.05.2024.
Sh. Sazid Khan, Proprietor of the industry attended the hearing and submitted written reply which has been taken on record. He submitted that the DTP has issued letter to their firm namely M/s Ludhiana Metal Finishers, St. no. 2, New Ram Nagar, Lohara Road, Gaispura, Ludhiana wherein it has been mentioned that as per the master plan, Ludhiana the site falls under the industrial mix zone. Further, vide Boards letter no. 610-12 dated 31.08.2023, it has been mentioned that a clarification in this regard has been sought from the DTP Ludhiana and the Competent authority of the Board has decided as under:-
"In view of the above clarification given by the District Town Planner, Ludhiana the industries located in industrial mix zone, which has now become conformity zone, as per the above mentioned notification shall be granted further consents as per policy of the Board"
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The industry shall get its trade effluent lifted to CETP operator, regularly.
2. The industry shall maintain the record of water consumption in the process and trade effluent got lifted to CETP operator.
3. The Environmental Engineer, Regional Office shall verify submission made by industry and send further recommendations in the matter.
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
