Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 15.05.2024 w.r.t. show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 to M/s National Steel Processors, Khasra No. 1168/430/1, Khata No. 36/47, Industrial Area-C, Village Kanganwal, Yuvraj Road, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is a small scale red category unit. The industry has applied for fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
The applications of the industry for consent to operate has been perused and it has been observed as under:-
1. The industry is red category unit and has been established without NOC of the Board.
2. The industry is newly commissioned unit and has not submitted month wise details w.r.t. water consumption and effluent generation from process from date of commissioning.
3. The industry has not registration certificate from Competent Authority as a proof of exact date of commissioning of the unit.
4. The industry has not submitted copy of certificate issued by DTP, Ludhiana.
The industry was show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 15.05.2024.
Sh. Amardeep Singh, Partner of the industry attended the hearing and submitted written reply which has been taken on record. He submitted that they have not aware regarding the NOC of the Board at time of operating the process. Now, their unit is fully established, accordingly applied for the consent to operate of the Board as per the regularized policy of the Board. The industry has regularly maintained the record regarding consumption of fresh water and untreated trade effluent lifted by the CETP operator. The industry has already submitted the electricity bill as proof of the date of commission. The site of the industry falls in industrial zone as per Khasra number mentioned in gazzete notification and the same have also been verified by Boards officers.
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The industry shall get its trade effluent lifted to CETP operator, regularly.
2. The industry shall maintain the record of water consumption in the process and trade effluent got lifted to CETP operator.
3. The industry shall submit the authenticated proof from Competent Authority regarding exact date of commissioning of the unit, within 07 days.
4. The Environmental Engineer, Regional Office shall verify submission made by industry and send further recommendations in the matter
