File Note: It is submitted that the industry is a medium scale red category unit. Earlier, the industry was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2017/6723120 dated 28/11/2017 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2017/6723078 dated 28/11/2017, both having validity upto 30/06/2021, subject to certain conditions and additional conditions mentioned therein. Thereafter, the industry has applied for obtaining renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, which were refused vide no. CTOW/Renewal/SAS/2023/22047816 dated 08.08.2023 and vide no. CTOA/Renewal/SAS/2023/21975037 dated 08.08.2023 due to certain violations. Thereafter, to check the compliance the industry was visited by AEE of this office on 21.03.2024 and contacted Sh. S.K. Saini, CEO and it was observed that: 1. The industry was in operation during the visit & engaged in manufacturing of auto parts of aluminium ingots. 2. The industry has provided aluminium melting furnace. However, the wet scrubber was not in operation. Even the hoods were not provided at few places. Further, the adequacy report of the APCD provided by the industry was not produced during the visit. 3. The industry has installed ETP and STP. However, the same was not in operation during the visit. 4. The plantation area was in bad shape (photographs attached), similar to as observed during earlier visit and effluent sample from stagnated effluent in plantation area was collected. 5. The industry could not produce record regarding hazardous waste generation & disposal. 6. The adjoining plot was found stagnated with solid waste & waste clothes, crucibles. The scrap area near the plot has a scrap briquetting machine & effluent generated from these machines is being discharged into the plot for stagnation. A sample of the same has also collected. 7. The industry has not submitted Bank Guarantee of Rs. 2.0 lakhs as an assurance to comply with Environmental Laws at all the times till date. 8. The industry has not applied varied consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 till date. 9. The industry is operating without the valid consents of the Board. From the above, it is clear that the industry is not complying with the earlier observations and decisions of personal hearing given to it. Accordingly, the industry was given personal hearing before the Senior Environmental Engineer (P) of the Board on 10.04.2024 and it was decided as under: - 1) Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar shall visit the industry immediately to verify the contentions given by it during hearing and thereafter process the applications on merits. 2) It was made clear to the industry that if any violation under the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 will be found in future action as deemed fit under the provisions of the said Acts shall be initiated against the industry without any further opportunity/ notice. Now, the industry has applied for obtaining varied consent to operate for addition of paint booth under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of auto parts (Compresser cover)@ 6000000 Nos/Year by using Core Sand @ 2 MTD, Aluminium Ingots @ 4 MTD along with requisite documents and fee. As per record file of the industry the previous consent fee is adequate upto 31.12.2023 under both acts against the total cost of fixed assets is Rs. 14.26 Crores. Now, the industry has deposited Rs. 1,96,800/- vide UTR No. N285232686502892 dated 12.10.2023 under Water Act, 1974 and Rs. 1,96,800/- vide UTR No. N285232686486205 dated 12.10.2023 under Air Act, 1981 and Rs. 49,700/- vide UTR No. N098232409468254 dated 08.04.2023 as penalty/late fee, against the total cost of fixed assets of Rs. 9.66 crores as on 27.03.2024. The consent fee deposited by the industry is adequate upto 30.06.2029 under both acts. The industry has submitted approved site plan prepared by Er. Ashok Tayal competent person from Director of Factories, Punjab. The industry has now submitted bank guarantee of Rs. 2.0 lacs vide BG No. E33GT02232590011 dated 16.09.2023 which is valid upto 15.09.2024 as an assurance to comply with Environmental Laws at all the times till date. The industry was visited by AEE of this office on 01.05.2024 and it was observed as under: 1. The industry was in operation during the visit & engaged in manufacturing of auto parts of aluminium ingots. 2. The industry has provided about 08 aluminium melting furnace provided with hood and common wet scrubber as APCD. The hoods and the wet scrubber have been repaired. The industry is only using fresh aluminium ingots and no scrap material is being utilized in the melting furnaces. 3. The industry has now installed automatic paint booth with water curtains as APCD. 4. The industry has provided ETP-cum-STP to treat the effluent generated from this section, which was in operation during the visit. 5. The effluent sample was collected from outlet of ETP-cum-STP during visit and results received from ZO lab, which is mentioned as below:- Sr. No. Parameters Outlet of ETP Prescribed Limits 1. pH 7.9 5.5-9.0 2. Iron mg/l 2.01 3 As per analysis results all the parameters are found within the prescribed limits of the Board. 6. The trade effluent and domestic effluent is being discharged onto land for plantation after treatment in ETP-cum-STP. 7. The industry has now removed the stagnation earlier observed and also now the plantation area as per Karnal Technology has been developed in additional 1 acre land and now the total plantation area as per Karnal Technology is about 2.5 acre. 8. The industry has now provided mechanism to collect and reuse the waste oil generated from this section and the stagnation observed during the earlier visit has been removed. 9. The industry is now maintaining record regarding abstraction of ground water and treatment of effluent in ETP and STP from the industry. 10. The industry has installed 04 DG set of capacity 2x750 KVA, 1x150 KVA, 1x910 KVA, with canopy and adequate stack. 11. The industry has installed 2 nos. shot blasting machine which are equipped with in-built bag house followed by stack of adequate height. 12. The industry is now complying with the observations of earlier visit. In the view of above, it is recommended that the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30.06.2029 with subject to suitable conditions and special conditions that: - 1. The industry shall operate its ETP-cum-STP adequately and efficiently and shall maintain the record regarding operation of the same. 2. The industry shall apply for obtaining authorization under the Hazardous and Other Wastes (Management and Trans-boundary Movement) Rules, 2016, within one month. 3. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 4. The industry has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments. 5. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 6. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time. 7. The industry shall ensure that the activity of unit does not create any nuisance in the surrounding areas and no public complaints are received. 8. The Consent is being issued to the industry based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time. 9. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
