File Note: It is intimated that the poultry farm is a small scale (as per value of plant & machinery) green category unit and was granted consent to operate under the Water Act, 1974 vide no. CTOW/Fresh/BAR/2022/19951051 dated 17/10/2022 valid upto 30/06/2023 and under the Air Act, 1981 vide no. CTOA/Fresh/BAR/2022/19702022 dated 14/09/2022 valid upto 30/06/2023 for the production of Layer Birds @ 50,000 nos. and Poultry Feed @ 5 T/day by using Chicks @ 50,000 Birds and Maize, Soya, Musted, Sun Flower, DOC Bazra, Lime stone & GNE @ 5 T/day subject to certain conditions as mentioned therein under the name of Smt. Rajani Rani, (Partner). It is also informed that the CPCB has framed Environmental Guidelines for layered poultry farms 10/01/2022. As per the said guidelines, the poultry farms are classified as under: 1. Small (5,000-25,000 bird) 2. Medium (above 25,000-1,00,000 birds) 3. Large (above 1,00,000 birds) Earlier, the consent to operate under the Water Act, 1974 and the Air Act, 1981 applied by the poultry farm was refused due to reason that poultry farm was found not compliant under the Water Act, 1974 and the Air Act, 1981. The poultry farm has submitted a request letter in reply of refusal certificate issued under the Water Act, 1974 vide no. CTOW/Renew/BAR/2023/22876147 dated 28.08.2023 and under the Air Act, 1981 vide no. CTOA/Renew/BAR/2023/22652685 dated 28.08.2023. The same has been attached in list of documents. Thereafter, the poultry farm had applied for consent to operate under the Water Act, 1974 and the Air Act, 1981 but same was returned to it due to the reason that the poultry farm had not submitted the new partnership deed after dissolution of previous partner. Now, the poultry farm has again applied for obtaining fresh consent to operate under the Water Act, 1974 and the Air Act, 1981 for the production of Layer Birds @ 50,000 nos. and Poultry Feed @ 5 T/day by using Chicks @ 50,000 Birds and Maize, Soya, Musted, Sun Flower, DOC Bazra, Lime stone & GNE @ 5 T/day under small scale green category under the name of Smt. Asha Rani w/o Sh. Balraj Krishan. Earlier, the poultry farm was run by 02 no. partners namely Smt. Rajani Rani w/o Sh. Rishav Garg and Sh. Balraj Krishan s/o Sh. Kesho Ram. Now. the poultry farm has submitted dissolution deed of partnership executed on 24.03.2023, according to which Smt. Rajani Rani got retired from the firm and Sh. Balraj Krishan is continuing the business. Thereafter, the poultry farm has submitted new partnership deed executed on 24.03.2023, according to which, there are now two partners namely Sh. Balraj Krishan s/o Sh. Kesho Ram and Smt. Asha Rani w/o Sh. Balraj Krishan, due to which it has applied for fresh CTO, however, there is no change in the production, land or building. Previous consent fee deposited by the poultry farm in last consent application is adequate upto 30/09/2024. The poultry farm has deposited consent fee of Rs. 67,700/- (Rs. 67,200/- as consent fee + Rs. 500/- as application fee) vide no. 651009894 dated 08.04.2024 under the Water Act, 1974 and Rs. 67,200/- vide no. 823332953 dated 08.04.2024 under the Air Act, 1981 against the value of fixed assets of Rs. 278.24 lakh (value of plant & machinery Rs. 123.25 lakh) as per CA certificate dated 08.04.2024. The fee deposited by the poultry farm is adequate upto 30.09.2031 (after deducting penalty fee of Rs. 8400/- under each act. (Fee calculated from 30.09.24, as CA certificate is same as previous) To verify the fact of the poultry farm, the site of the poultry farm was visited by the officer of this office on 16/04/2024 and it was observed as under:- 1. The poultry farm was located at Karamgarh road, Village Bhadalwad, Tehsil & Distt. Barnala. There are no residential houses/ area in the radius of 500 meters of the poultry farm. 2. The poultry farm was in operation during visit. It is a layered poultry farm having approx. 50,000 birds. From which 35000 are grown birds and 15000 are chicks. 3. The poultry farm has constructed 02 no. single story layered poultry sheds and 01 no. double story chick shed. 4. The poultry farm has installed its own feed mill of capacity 4.0 tons/day in its premises with APCD. 5. Domestic effluent was being discharged onto land for plantation after passing through septic tank. 6. The poultry farm has also constructed paved holding tank to collect the wastewater arising from poultry shed. 7. The house keeping of the poultry farm was good. 8. The poultry farm constructed 05 no. burial pits for disposal of the dead birds inside the premises covered from top. Out of the 05 burial pits, 03 pits were permanently closed and 01 was full of dead birds and 01 pit was in use. The poultry farm is now complying with the guidelines issued by the CPCB/PPCB. In view of above, it is recommended that consent to operate under the Water Act, 1974 and the Air Act, 1981 may be granted to the poultry farm upto 30.09.2031 (upto adequacy of fee) with the usual conditions, please.
