It is submitted that the industry was earlier granted Consent to operate under the Water Act, 1974 & the Air Act, 1981 vide no. G16MOGCTOW4489111 & G16MOGCTOA4488813 dated 06.09.2016 for operation of the unit for production of fuel briquettes @ 12 TPD by using Press Mud/Saw dust/Cow dung/Agriculture Waste as raw material, with validity upto 31.12.2020 alongwith conditions mentioned therein.
Thereafter, the industry was visited by undersigned (AEE) on 27.03.2024 and it was observed as under:
1. The industry was in operation during visit and engaged in manufacturing of pellets.
2. The industry was engaged in manufacturing of pellets from sugarcane waste (mael), press mud and saw dust.
3. The industry had stored paddy straw at site, however physical condition of same indicates that it has not been used by industry for manufacturing of pellets.
4. The industry has stored its raw material in an open atmosphere.
5. The industry is violating the special conditions imposed in the consent granted to the industry.
6. The industry has claimed that they have using paddy straw 80% for manufacturing of pellets. But, as per physical condition, same is not being used by the industry.
Accordingly, the industry was issued SCN for violating the provisions of the Water Act, 1974 & the Air Act, 1981 with an opportunity of personal hearing before Environmental Engineer, Regional Office, Faridkot on 15.04.2023. But, no-one from the industry has attended the hearing.
Now, the industry has applied for obtaining varied consent to operate of the Board from pollution angle through OCMMS on 11.05.2024 for production of Fuel Briquette @ 12 TPD by using Paddy Straw @ 9.60 TPD and Press Mud Saw Dust Cow Dung @ 2.40 TPD, details of the case is as under:
1) The industry has submitted copy of CA certificate dated 07.02.2024, showing value of gross fixed assets of Rs. 11.70 lakhs as on 31.01.2024. The industry has deposited Rs. 18600/- (Rs. 7000/- vide UTR / Ref. No. 945941357 dated 05.04.2024 and Rs. 11600/- vide UTR / Ref. No. 133453412 dated 11.05.2024 under the Water Act, 1974) & Rs. 18600/- (Rs. 7000/- vide UTR / Ref. No. 929314516 dated 05.04.2024 and Rs. 11600/- vide UTR / Ref. No. 22624387 dated 11.05.2024 under the Air Act, 1981), which is adequate upto 31.12.2029 under both the Acts.
The industry was again visited by undersigned (AEE) on 11.05.2024 and it was observed as under:
• The industry has installed 2 no moulding cum press machines for fuel briquettes unit, which were in operation. The industry has stored paddy straw / press mud / saw dust / agri waste as raw material in its premises.
• The industry has installed cyclone as APCD to control dust emissions generated during feeding of raw material into the molding machines. .
• Now, the industry was using paddy straw / press mud / saw dust / agri waste as raw-material for manufacturing of fuel briquettes. No dryer has been installed by the industry.
• During visit to the industry, it was found that the industry has stored the press mud in the enclosed shed and the briquette manufacturing activities were also carried out in the closed processing shed.
• No trade effluent is being generated. Only domestic effluent is being generated, which is disposed onto land for plantation after septic tank.
• The industry has planted trees/sapling along its boundary wall.
• The industry is complying with the provisions of the Water Act, 1974 & Air Act, 1981.
Keeping in view of the above, it is recommended as follows
1. Varied consent to operate applied by the industry under green category for production of Fuel Briquette @ 1 TPD by using Paddy Straw @ 1.04 TPD and Press Mud Cow Dung & Agri Waste @ 0.26 TPD, may be granted to the industry for a period upto 31.12.2028 with suitable conditions and specific conditions as under:
a) The industry will store and process/mix the raw material within enclosed structure and will not store/mix the raw material in the open atmosphere.
b) The industry will not create any nuisance to the surrounding area with its operation/ storage of raw material.
2. The show cause notice for violating the provisions of the Water Act, 1974 & the Air Act, 1981 earlier issued may be dropped.
