Subject: - Proceedings of the personal hearing given to M/s Jain Mix Board, Gobindpura Road, Village Sangreri Bareta, Tehsil Budhlada, Distt. It was brought out that the industry was granted 'consent to establish' (NOC) under Water Act, 1974 & Air Act, 1981 dated 18.07.2022 (Valid upto 17.07.2023) for production of card Board/Mix Board @ 8 TPD by using Primary ETP sludge of pulp & paper mill @ 5 TPD, Paddy Straw @ 3.25 TPD, Jute Bags/Cow Dung @ 3.25 TPD as raw material................
Thereafter, the industry applied for obtaining fresh consent to operate under the Water Act, 1974 & Air Act, 1981 which was refused vide no. CTOW/Fresh/MNS/2024/24176188 and CTOA/Fresh/MNS/2024/24176069 both dated 13.03.2024 due to various observations mentioned therein................
Now the industry has applied for obtaining fresh consents to operate under the Water Act, 1974 & Air Act, 1981 for production of card Board/Mix Board @ 8 TPD................
The industry was visited by officer of the Board on 24.04.2024 and it was observed that:- ...........
1. The industry was in operation during visit and also found utilizing ETP sludge of pulp & paper mill without obtaining authorization/passbook as required under the HOWM Rules, 2016..............
2. The industry has installed 2 no. card board rolling machines, which were in operation and was also in process to install 02 more such machines..............
3. No flow meter installed on the line provided for re-utilization of the effluent back into process. The purge water was found discharged outside the boundary wall of the industry..............
The industry is not complying with the conditions of 'consent to establish' (NOC) granted under the provisions of Water Act, 1974 &Air Act, 1981 and also failed to comply with guidelines of SOPs framed for such type units..............
In view of above, show cause notice before consents to operate under the provisions of the Water Act, 1974 and Air Act, 1981 issued to the industry alongwith an opportunity of personal hearing before the Senior Environmental Engineer on 08.05.2024................
During hearing, the Manager of the industry attended the hearing and submitted that the industry was operated only on the trial run and is not being operated for commercial production. He further submitted all the shortcomings observed during the visit by the officer of the Board have been attended and requested to grant CTOs under the Water Act, 1974 & Air Act, 1981.................
After hearing the Manager of the industry as well as officer of the Board, it has been decided by the Senior Environmental Engineer (B) that:-.................
1. The industry shall not procure and process any waste as prescribed in Schedule-I appended to the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 till it gets the certificate of registration / passbook as recycler /re-processor from the Board..............
2. The industry shall apply for obtaining authorization alongwith registration/ passbook under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 at the earliest..............
3. Environmental Engineer, Regional Office, Bathinda shall visit the industry, verify the submission of the representative of the industry and process the application applied by the industry under the Water Act, 1974 & Air Act, 1981, on merits.................
