File Note: It is intimated that the industry was granted ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/SAS/2024/25495212 dated 13/05/2024 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/SAS/2024/25495165 dated 13/05/2024, both having validity upto 30/09/2025 for manufacturing of Crushing of River Bed Material @2000 CFT/day as product, subject to certain condition as mentioned therein. Now, the industry has again applied for obtaining ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, along with requisite document. The industry has now submitted an copy of undertaking along with the online application form, which is reproduced as under: “We here by undertake that the we have complied all the guidelines and conditions mentioned in the earlier granted consents. The copy of the compliance report enclosed herewith. And, now we are applying for ‘consent to operate’ for grant us consents upto the valid fee available with the Board” As per the record file, the industry had deposited consent fee, which is adequate upto 31.12.2028. Visit: Accordingly, the industry was visited by AEE of this office on 17.05.2024 during visit, it was observed as under: 1. The stone crusher was not in operation and is engaged in crushing of stone into aggregates of different sizes. 2. The industry has installed 01 no. Jaw machine and 01 no. vibrating screen in its premises. The industry has provided shed over the jaw crushing machine. 3. The industry has provided chutes of the end of conveyer belts of the stone crusher. 4. The industry has provided some tree along the ramp of the unit and the representative has been advised to provide more plantation along the boundary wall in the upcoming season. 5. The industry has stabilized the road leading to haudi of the stone crushing unit. The representative of the industry informed that as and when crusher is operated, sprinkling system is also operated to suppress the dust emissions. 6. The industry has installed one no. tubewell in its premises and flow meter is yet to be installed with the same. 7. The industry has provided water sprinkling system at the transfer points in its stone crushing unit. From above, it is clear that the industry is complying with the earlier observations. Recommendations: In view of above, may if approved, it is recommended that the ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30.09.2028 subject to suitable conditions and the following additional conditions as under: 1. This ‘consent to operate’ is being granted to the industry in supersession to the earlier ‘consent to operate’ granted under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/SAS/2024/25495212 dated 13/05/2024 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/SAS/2024/25495165 dated 13/05/2024, both having validity upto 30/09/2025. 2. This consent is only for operation stone crusher of capacity 2000 CFT/day. 3. The industry shall comply with the code of practice laid down by the Board for such kind of units, at all times. 4. The industry shall not add any additional machinery and/or land area in its premises, without prior permission of the Board. 5. The industry shall continue operating the water sprinkler system to suppress the dust emission. 6. The industry shall install flow meter with the tubewell installed in the premises. 7. The industry shall not install machinery of screening cum washing plant in its premise, without prior permission of the Board. 8. The industry shall keep the shed installed over the stone crushing machinery in good conditions, at all times. 9. The industry shall plant more trees in its premises during this season and submit compliance of the same to this office. 10. The industry shall not take participate any illegal mining activity and shall not procure raw material from any illegal mines. The industry shall obtain permission from Mining Department & submit a copy of the same to the Board. 11. The unit shall ensure that no nuisance is created in the vicinity of its premises from the operations of its service station. In case, any complaint is received against the unit, the Board shall be at liberty to revoke/ cancel this consent without giving any opportunity of hearing to the industry. 12. The ‘consent to operate’ is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing. 13. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent. *Competency- Environmental Engineer, Regional Office, SAS Nagar
