Subject: - Proceedings of the personal hearing given to M/s Hotel The Grand Mirage, Village Amargarh, Bathinda-Goniana Road, Tehsil & District Bathinda before refusal of consents to operate under the provisions of Water Act, 1974 & Air Act, 1981 by the Senior Environmental Engineer on 29.04.2024..............

It was brought out that the hotel-cum-banquet hall was granted 'consent to establish' (NOC) under the provisions of Water Act, 1974 & Air Act, 1981 on 05.04.2023 (valid upto 04.04.2024) for establishment of the Hotel-cum-banquet hall having 2 no. Banquet Halls of capacity @ 500 persons/ function & 200 persons/ function alongwith rooms @ 40 Nos, 1 no. Bar and 1 no. Restaurant...............
The hotel-cum-banquet hall applied for obtaining fresh consents to operate under the provisions of the Water Act, 1974 & Air Act, 1981....................
The hotel-cum-banquet hall was visited by the officer of the Board on 02.04.2024 and it was observed that:-............
1. The project proponent has installed STP, which was found bye-passed and the overflow of the untreated effluent was directly being discharged into adjoining land for stagnation.................
2. The hotel-cum- banquet hall has not provided any compost pits for in house management of the solid waste and the solid waste generated is lifted to an un-authorized vendor(s) in violation to the Solid Waste Management Rules, 2016...............
3. The hotel-cum-banquet hall has provided one D.G. set of unknown capacity, which is without any canopy/adequate stack height.................
The hotel-cum-banquet hall is violating the provisions of the Water Act, 1974 & Air Act, 1981 as well as with the code of practice prescribed by the Board vide notification dated 02.02.2021...................
In view of above, show cause notice before refusal of 'consents to operate 'under the provisions of the Water Act, 1974 & Air Act, 1981 has been issued to the hotel-cum-banquet hall alongwith an opportunity of personal hearing before the Senior Environmental Engineer on 29.04.2024.....................
During hearing, the Partner of the hotel-cum-banquet hall attended the hearing and submitted written reply w.r.t. notice issued to it, which has been taken on record. He further stated that STP installed is now in operation and the stagnation in the adjoining land area has been removed. Compost pits have now been provided. DG Set with canopy & adequate stack height installed at site and the one DG set which was without canopy has been removed from the site.................
After hearing, the Partner of the industry as well as the officer of the Board, it has been decided by the Senior Environmental Engineer of the Board that the Environmental Engineer, Regional Office, Bathinda shall visit the site of hotel-cum-banquet hall, within 07 days, verify the submission made by the prop. of hotel-cum-banquet hall and process the consent applications applied by it under Water Act, 1974 & Air Act, 1981, on merits.................
