File Note: Siting Criteria Local Government, Punjab, vide letter no. PB/CLU/LDH/LUDHI/1588 dated 11.03.2022 has granted Change of Land Use (C.L.U.) for land measuring 1572.91 sq.mts. located at B-6-773-723-722-724-724/1 ABADI GOWSHALA ROAD TARAF SAIDAN LUDHIANA, Ludhiana. The site falls in Residential as per Master Plan Ludhiana (2007-2021). The permission for C.L.U. for Commercial use has been granted by the concerned Department. As per Board’s policy i.e. Deptt. of Science, Technology, Environment and Non-conventional energy notification no. 2274 dated 25.07.2008, the State Govt. vide its notification no. 3/6/07/STE (4)/2851 dt.7.8.2007 laid down the siting policy/guidelines for establishment of residential colonies, commercial establishment like shopping malls, multiplexes in the State of Punjab, wherein, a minimum distance of 100 metres from the source of pollution hazard of the Maximum Accident Hazard (MAH) industries notified by Director General Factory Service Labour Institute to the building line of residential colonies/commercial complex was prescribed. In the subject cited case, as per report of visiting officer, there is no MAH unit within 100 mtr radius of the proposed site. Therefore, the proposed site is suitable for proposed project. List of MAH units in the state of Punjab is attached herewith. Solid waste disposal The project proponent has not proposed any solid waste generation in the application form. Also, it has not submitted any agreement with Municipal Corporation, Ludhiana for disposal of solid waste. Sewage Treatment Plant The project proponent has proposed to discharge untreated domestic effluent @ 1 KLD into Municipal Council sewer, which seems adequate as Municipal Council sewer at the proposed site is connected to terminal Sewage Treatment Plant and proposed discharge is very less. However, the calculation of domestic effluent is as under: Commercial Plots @ 55 shops @ 10 persons = 550 persons Flow for 550 persons @ 45 ltr/day (shops) 550 @ 45 lit./person/day i.e. 24.7 M3 /day Total domestic water required @ 24.7 M3/day 80 % of the total domestic water to terminal STP i.e. 19.76 KLD As per Punjab Pollution Control Board office order no. 315 dated 05.07.2018 regarding installation of sewage treatment plants for residential/commercial complexes/construction projects proposed to be established/being established, it was decided as under: “If the residential colony/commercial complex/construction project is proposed to be established within the municipal limits of a City/Town of the State and it proposes to discharge its entire sewage into the municipal sewer, then the promoter of the residential colony shall install adequate and appropriate individual sewage treatment plant. The project proponent shall make arrangements to re-use the treated effluent for flushing purposes and/or for watering of green areas in the project premises. Only the surplus treated waste water shall be discharged into the MC sewer.” In view of above, if may approved, ‘consent to establish’ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the project proponent for one year with usual conditions & with following special conditions: 1. The project proponent shall install STP of capacity atleast 20 KLD at the site. 2. The project proponent shall reuse treated wastewater for flushing purpose by providing dual plumbing system in the project. The project proponent shall impose a condition in this regard in all the allotment letters/registries to be done in the project. 3. The project proponent shall submit agreement with Municipal Corporation, Ludhiana for disposal of solid waste. If there will be any generation of organic waste, then the project proponent shall either install mechanical composter or construct compost pits for treatment of the same. 4. This NOC has been granted to the project proponent on the bases of layout plan submitted along with online application. 5. In case, there is any change in the layout plan submitted with this online application and the final layout plan approved by the competent authority, this NOC shall be considered as cancelled, automatically. And the project proponent shall be bound to obtain revised CTE from PPCB. 6. The project proponent shall not carry out any activity in its premise, which is covered under the ambit of EIA notification dated 2006. 7. The project proponent shall comply with the guidelines issued by PWRDA and shall obtain permission from PWRDA for abstraction of ground water. 8. The project proponent shall be granted ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974, only after accessing the arrangements for disposal of treated effluent at that point of time. PPCB shall not be responsible for any loss to the project proponent in this regard, howsoever. 9. The industry shall not discharge the effluent into any drain/choe/nallah, in any case. 10. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 11. The industry has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments. 12. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 13. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time. 14. The NOC is being issued to the project proponent based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing. 15. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent. Competency- Senior Environmental Engineer being building construction and area development project having total project cost less than 10 crore.
