It is submitted that the project proponent has applied for obtaining fresh consent to establish (NOC) from pollution angle under orange category under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for development of commercial plotted project consisting of 72 plots (including 02 no. Restaurants and 02 no. Food courts) in an area of 38139.91 sqm (9.425 acres) alongwith requisite documents. The project proponent has deposited Rs. 18500/- vide R. no. 741521691 dated 30.03.2024 as consent to establish (NOC) fee. The fee deposited by the project proponent is adequate for one year against the total proposed cost of the project Rs. 856.41 lacs. It is further submitted that during the scrutiny of the application various observations were observed and raised clarification to the project proponent with the request to submit the same within 02 days. The project proponent has submitted reply to the clarification and same is given as under: S. No. Observations Reply submitted by the project proponent 1. The project proponent has applied for consent to establish (NOC) for development of “Commercial Plotted colony with No. of Show Rooms-78 Nos including Restaurants -02 Nos, Food Courts-02”. However, the site plan approved by the Competent Authority only for development of 72 SCO only. The project proponent needs to clarify the same or needs to submit revised layout plan of the project approved by Competent Authority regarding development of “Commercial Plotted colony with No. of Show Rooms-78 Nos including Restaurants -02 Nos, Food Courts-02”. Further, the disposal detail of 40 KLD in an area of 8500 m2 is not adequate for winter & rainy season. The project proponent needs to submit adequate disposal detail for excess treated effluent. By mistake 78 SCOs mentioned in NOC application form. Actually there are 72 in Nos. Kindly read as 72 in Nos. As on now disposal of 40 KLD waste water has been proposed in 8500 M2 own Green parks/Horticulture area inside the project. However we have total land area at site is about 20.24 Acre. Land registration deeds of 9.73 Acre,2.58 Acre,2.93 Acre and 5.0 Acre land are attached with this reply. During rainy and winter season if there is any shortfall when the project will fully inhabited, we will develop 2000 M2 plantation area as per Karnal technology adjoining the site for the disposal of about 25-30 M3/day of waste water. 2. The project proponent has not submitted authority letter. Auth. Letter of Mukesh Kumar, Partner is attached herewith. 3. The project proponent has not submitted land documents of the project. Find land registration deed of 9.73 Acre land for the verification of Project Land value of 9.45 Acre. Total land value including registration charges is about 203.70 Lac of 9.73 Acre land. 4. The feasibility report submitted by the project proponent is not proper i.e. water calculation detail as per National Building Code, 2016. Revised feasibility report with correct water calculations as per NBC-2016 for Restaurant and Food court is also attached herewith. The project proponent has submitted a copy of letter issued by Department of Town and Country Planning, Punjab vide memo no. 1192 dated 08.12.2022 to Sh. Sahil Gupta S/o Aruan Gupta, Authorized M/s Maa Bhagwati Developers regarding issue of Change of Land Use (CLU) for Commercial Purpose (Commercial Colony) for land measuring 75K-08M (9.425 acres) falls in Village Rampur Mehrab (H. B. No. 264), Tehsil Morinda, District SAS Nagar. The project proponent has submitted layout plan approved by Competent Authority regarding development of Commercial Colony consisting of 72 no. commercial plots. The project proponent has submitted partnership deed executed between: 1. Mr. Vijay Sharma S/o Mr. Ram Rattan Sharma R/o H. No. 194, Kaplish Niwas, Ramgariha Gurdwara Road, Morinda, District Rupnagar (hereinafter called to as the party of First Part). 2. Mr. Naresh Kumar S/o Mr. Bhagat Ram R/o Ward No. 3, Tehsil Khamanon, Khamano Kalan, District Fatehgarh Sahib (hereinafter called to as the party of Second Part). 3. Mr. Sahil Gupta S/o Mr. Arun Gupta R/o Ward No. 5, Sugar Mill Road, Morinda, District Rupnagar (hereinafter called to as the party of Third Part). 4. Mr. Mukesh Kumar S/o Mr. Vijay Kumar R/o H. No. 41-A, Ward No. 10, New Adarsh Nagar, District Rupnagar (hereinafter called to as the party of Fourth Part). 5. Mr. Sawinder Singh S/o Mr. Ishar SinghR/o H. No. 125, Ward no. 7, Morinda, District Rupnagar (hereinafter called to as the party of Fifth Part). The project proponent has submitted feasibility report and as per feasibility report, the total water requirement of the project is 83.5 KLD, which will be met through tubewell. The total wastewater generated from the project will be 66.8 KLD which will be treated in proposed STP of 75 KLD capacity. After treatment in STP, the treated wastewater will be utilized in flushing purpose as well as dispose of onto Green/Horticulture area @ 8500 M² available within the project premises & 0.5 acre (~2000 sqm) plantation area will be developed as per Karnal technology for the disposal of treated waste water. The total quantity of solid waste to be generated from the proposed project has been estimated as 510 Kg/Day and them same are to be collected at earmarked MSW storage area. Biodegradable waste will be used as composter by vermi-composting pits/ mechanical composter & non-recyclable waste will be dumped to authorized MC dumping site. The site of the proposed project was visited by the undersigned on 16.05.2024. During the visit, it was observed as under: 1. The project proponent has earmarked the boundary of the site by metal sheets/poles and construction work has already started at site and slab of about 45 showrooms has been laid and construction work of 1 drive thru is completed about 50 %. 2. As per the boundary limits of the site shown by the representative of the promoter company during the visit, there is no operational approved existing MAH industry within a radius of 250 m from the boundary of the proposed site of the project. There is no operational approved existing air polluting source industry falls within a radius of 100 m from the boundary of the project. 3. The site is suitable for such type of project as per policy of the Board dated 30.04.2013. 4. As per approved layout plan, the total built up area of the project will be 13346.60 sqm, which is less than 20000 sqm, therefore, the project is not required to obtain prior Environmental Clearance under EIA Notification dated 14.09.2006. In view of the above, may if approved, it is recommended that consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted for one year subject to suitable terms and conditions and following additional conditions that: 1. The project proponent shall develop atleast 2000 sqm area as per Karnal Technology as per feasibility report submitted by the project proponent. 2. The project proponent shall install STP of capacity 75 KLD alongwith ultra-filtration system for utilization of treated wastewater for flushing purposes. 3. The project proponent shall provide dual plumbing for utilization of treated wastewater for flushing purposes. 4. The project proponent shall provide mechanical composter of capacity for the treatment of wet biodegradable waste. 5. The project proponent shall provide occupancy only after obtaining consent to operate from the Board under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. 6. The promoter shall develop its project strictly in accordance with the layout / building plans approved by the Competent Authority. 7. The promoter shall lay down pucca distribution network / pipe grid from the STPs to the various green lawns / stretches / dual plumbing system for flushing purposes / for construction activities and shall not allow it to stagnate anywhere inside or outside the project. 8. The promoter shall irrigate the green belt / area to be developed within the project area with the treated wastewater only and no fresh water will be used for this purpose as well as for construction activities within the project. 9. The promoter shall ensure the compliance of the Solid Waste Management Rules, 2016 as well as the Construction and Demolition Rules, 2016. 10. The promoter shall comply with the bye laws of the Master Plan of the area notified by the Government. 11. If the project proponent violates any of the above 6 conditions, legal action under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 will be initiated against the project proponent without affording any opportunity. 12. The promoter company shall submit the complete drawing and design of the STP and its component at the time of obtaining consent to operate. 13. The promoter company shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. 14. The promoter company shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be got lifted. 15. The promoter company shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing on-site facility to produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner. 16. The promoter company shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste. 17. The promoter company shall comply with the provisions of the Construction and Demolition Management Rules, 2016. 18. The promoter company shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disburse in the air in any form. 19. The promoter company shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form. 20. The promoter company shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project. 21. The promoter company shall ensure that the vehicles carrying construction material and construction debris of any kind shall be cleaned before it is permitted to ply on the road after unloading of such material. 22. The promoter company shall provide mask to every worker working on the construction site and involved in loading / unloading and carries of construction material and construction debris. 23. The promoter company shall provide all medical help, investigation and treatment of workers involved in construction of building and carrying out construction material and debris related to dust emissions. 24.
