It is submitted that the industry is a small-scale green category poultry farm. Earlier, the poultry farm was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 vide Boards letter no. 4902 dated 03.09.2013 and Air (Prevention & Control of Pollution) Act, 1981 vide Boards letter no. 4900 dated 03.09.2013, both having validity upto 31.12.2023 with enhancement capacity of 45000 eggs/day with subject to suitable condition and special conditions mentioned therein.
Now, the poultry farm has applied for obtaining renewal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for same production capacity along with requisite documents and fee.
The poultry farm has deposited Rs. 46,700/- vide UTR No. N123243015348446 dated 02.05.2024 under Water Act, 1974 and Rs. 46,700/- vide UTR No. N123243015442008 dated 02.05.2024 under Air Act, 1981, against the total cost of fixed assets is Rs. 292.29 lacs as on 24.04.2024. The Consent fee deposited by the industry is adequate upto 31.12.2028 under both acts after adjusting penalty/late fee.
As per office order issued by the Head Office, Patiala vide letter no. 59 dated 02.02.2016 and as per decision of officer meeting held at Head Office Patiala on 08.05.2018 that all the industries under orange and green category shall be processed on the basis of documents submitted by the industry without site verification.
The industry has not been visited and on the basis of documents submitted by the industry alongwith application, the poultry farm has capacity of 45000 eggs/day. There is no source of trade effluent and only domestic effluent is being discharged onto land for plantation after treatment in septic tank. The poultry farm has installed one no. DG set of capacity 40 KVA, which is equipped with canopy and stack of adequate height.
The poultry farm has submitted compliance report of previous consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 granted to it.
In view of above, it is recommended that ‘consent to operate’ under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 31.12.2028 with subject to suitable conditions and following additional conditions:
1) The poultry farm will follow the Environmental guidelines prescribed by the CPCB for poultry farms.
2) The poultry farm will keep on regularly spraying the pesticides to curb the problem of flies and foul odour so that there are no complaints regarding the same.
3) The poultry farm will ensure that there is no complaint regarding foul smell and flies occur, failing which, action shall be taken against the poultry farm under the provisions of the said Act.
4) The poultry farm shall not start any new process within its unit which may change its category from Green to Orange/Red, without the prior written permission of the Board.
5) The poultry farm shall not discharge its untreated/ treated effluents into any River/Drain/Choe etc., directly/ indirectly, under any circumstances.
6) The poultry farm shall ensure that no water pollution problem is caused in and around the area, due to operation of the unit.
7) The poultry farm has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments.
8) The Consent is being issued to the poultry farm based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the poultry farm and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
9) In case the poultry farm fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the poultry farm.
10) The poultry farm shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time.
