It is submitted that the industry was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Varied/PTA/2018/7735004 dated 25/07/2018 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/PTA/2023/20995519 dated 17/03/2023 both are valid upto 30/09/2024 for manufacturing of IMFL bottling of Liquor @ 12000 bottles (750 ML)/Day by using Spirit @ 5500 Liter/day, Bottles @ 12000 Numbers/Day, CC Box @ 1200 Numbers/Day, Food flavor @ 50 Liter/day as raw material, subject to certain conditions mentioned therein.
After that, show cause notice for revocation of the consent to operate granted under the Water (Prevention & Control of Pollution) Act, 1974 was issued vide Board's letter no. 10236 dated 15/01/2024 with an opportunity to appear in person before the Senior Environmental Engineer (ZP-I), Punjab Pollution Control Board, Zonal Office-I, Vatavaran Bhawan, Nabha Road, Patiala on 25.01.2024 at 11:00 am.
After hearing the officer of the Board, representative of the industry and material facts on the record, the Senior Environmental Engineer, decided as under: -
1. The industry shall submit the Bank Guarantee amounting to Rs. 1 lac as an assurance to comply with the Environmental Laws, within 7 days.
2. The industry shall remove all the observations of the visiting officer, within 7 days and submit compliance to the office of Environmental Engineer, Regional Office, Patiala.
3. Environmental Engineer, Regional Office, Patiala shall visit the industry, carryout the sampling of the ETP, verify the decisions of the personal hearing and other compliances and submit its report, within one month.
Now, the industry has applied for NOC expansion under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Existing : IMFL Bottling of Liquor @ 12000 Bottles (750 ml)/day, Proposed Addition: IMFL Bottling of Liquor @ 48000 Bottles (750 ml)/day , Total after Expansion : IMFL Bottling of Liquor @ 60000 Bottles (750 ml)/day by using Existing : Spirit 5500 Liter/day , Existing : Bottles 12000 Numbers/Day, Existing : CC Box 1200 Numbers/Day, Existing : Food Flavour 50 Liter/day, Proposed Addition : Spirit/ENA 19500 Liter/day, Proposed Addition : Bottles 48000 Numbers/Day, Proposed Addition : CC Box 4800 Numbers/Day, Proposed Addition : Food Flavour 200 Liter/day, Total after Expansion : Spirit/ENA 25000 Liter/day, Total after Expansion : Bottles 60000 Numbers/Day, Total after Expansion : CC Box 6000 Numbers/Day, Total after Expansion : Food Flavour 250 Liter/day as raw material. The industry has deposited Rs. 10800/- against the project cost of proposed expansion of Rs. 129 lakh, which is adequate for one year.
The industry was visited by undersigned on 29.04.2024 and contacted Sh. Sanjay Kumar, Manager at site. During visit, it was observed as under:
1. The industry was in operation at the time of visit.
2. The industry carries out the process of blending of ENA with water & food grade flavors and colour.
3. The industry has provided three bottling lines and 3 no. rinsing tanks for bottle washing.
4. The industry has installed one no. D.G. set of 65 KVA with canopy and stack of adequate height.
5. The industry has not installed any boiler and is not using any kind of fuel for burning purpose except HSD for D.G. set.
6. The industry has provided ETP for treatment of waste effluent generated. No flow at the outlet of ETP is available due to less flow at inlet, therefore, sample could not be collected.
7. The industry has repaired the ETP and plantation area has also been improved for handling the discharge of treated effluent.
8. The industry has also submitted bank guarantee dated 16.02.2024 amounting to Rs. 1.0 lakh as per the decision of personal hearing.
The industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & Air Act, 1981 and decisions of personal hearing.
The industry has submitted Tehsildar certificate dated 08.05.2024, in which it was mentioned that no lal lakir, municipal limit, residential area was observed within 100 m from the site.
The industry has proposed for expansion in its existing premises and there is no addition of land. Therefore, the site falls in the Tehsil Patran, where no Master Plan has been prepared only LPA has been declared.
Therefore, the site is suitable for expansion.
In view of above, it is recommended that the consent to establish (NOC expansion) may be granted to the industry for one year with suitable conditions.
