SAS Nagar w.r.t SCN for refusal of consent to operate applied under the Water Act, 1974 and the Air Act, 1981 before the Senior Environmental Engineer (P) of the Board on 20/5/2024 The following were present: From Board's side: Er. Jaspreet Singh, Partner The officers of the Board brought out that the project proponent has applied for obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for Marriage Palace having capacity 350 Persons/ function alongwith requisite documents. The site of the marriage palace was visited by officer of the Board on 2/5/2024 and it was observed as under: 1) The marriage palace was not in operation due to off season. 2) The marriage palace has hall of size 150’ x 90’ and lawn of size 80’ x 130’ for organizing marriage functions. The representative of marriage palace informed that gathering of 300-350 persons can be occupied in marriage palace. 3) The marriage palace has provided septic tank of size 15’ x 30’ x 12’ for treatment off domestic effluent and after treatment it is used for irrigation of lawn and plantation/ hedges provided alongwith boundary wall. The marriage palace has not installed STP for the treatment of domestic effluent generation form the marriage palace. 4) The marriage palace has provided 2 no. kitchens and oil & grease trap has been provided for kitchen wastewater. After oil & grease trap wastewater is treated in septic tank. The marriage palace has not provided ducting for emissions for cooking. 5) The marriage palace has not provided compost pits/ mechanical composter for treatment of wet waste. 6) The marriage palace has installed 2 DG set of capacity 200 KVA & 82 KVA which are equipped with canopies but inadequate stack height. The marriage palace is not complying with the measures suggested for control of water pollution, air pollution & solid waste management in the mechanism guidelines framed by the CPCB and adopted by PPCB vide letter no. SEE(HQ-2)/2021/64 dated 2/2/2021. The industry is violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981, willfully causing pollution in the vicinity, thus violating the provisions of the said Acts, intentionally and deliberately. It was proposed to refuse the consent to operate applied under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, after affording an opportunity of show cause-cum-personal hearing. Therefore, the industry was served show cause notice for refusal of consent to operate applied under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 alongwith an opportunity of personal hearing vide Board's letter no. 916-17 dated 15/5/2024 before the Senior Environmental Engineer (ZP-1) of the Board on 20/5/2024. The representative of the industry attended the hearing and has not submitted any written reply of notice. However, he further informed that the compliance of most of the points have already been made at the site. He requested for sometime to comply with some observations made by the visiting officer. After hearing the representative of the industry and officer of the Board, the Senior Environmental Engineer (ZP-1) of the Board decided that: 1) The industry shall submit bank guarantee amounting Rs. 1.0 Lakh to the O/o Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar, within 7-days as an assurance to comply with Environmental Laws all the times. 2) Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar shall re-visit the industry after 7-days to verify the compliance made by the industry as earlier observed by the visiting officer and thereafter send the report alongwith fresh recommendations. If approved, proceedings of the personal hearing as above may be conveyed to the industry and Environmental Engineer, PPCB, RO, SAS Nagar for compliance and sending the report, respectively.
