File Note: It is submitted that the project proponent was given personal hearing before the Senior Environmental Engineer of the Board on 02.04.2024 for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and wherein it was decided that:- 1. The project proponent shall submit the bank guarantee of Rs. 1.0 lac as an assurance to comply with the Environment Laws. 2. The project proponent shall develop the proper plantation area for disposal of domestic effluent in efficient manner. 3. Environmental Engineer, Regional Office-4, Ludhiana shall visit the project to verify the contentions of the project and process the consent applications on merit. In compliance of the above said hearing, the site of the project was revisited on 20.05.2024 and it was observed as under: 1. the industry has now deposited a bank guarantee of Rs. One Lac bearing no. 49970ILG00524 dated 08.05.2024, which is valid upto 07.05.2025 as an assurance to comply with the Environment Laws. 2. The industry is now developing plantation area for utilization of its treated domestic effluent from the STP and has now new trees and plantation area is adequate for current discharge. 3. The project proponent has now complied with the decision of personal hearing and provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Keeping in view of above, it is proposed that partial consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the project upto 30.09.2029 with suitable conditions as per the Board's policy and subjected to the following special conditions:- 1. The project proponent shall maintain the proper plantation area for disposal of domestic effluent in efficient manner. 2. The project proponent shall get its samples of treated domestic effluent analyzed from Board's lab within 03 months. 3. The project proponent shall obtain revised consent after full completion and occupancy of the project. 4. The project proponent must shall obtain the Environmental clearance in accordance with the EIA notification of 2006 and its any subsequent amendments, as directed by the Ministry of Environment, Forest and Climate Change (MoEFCC), in future, if Board gets the confirmation of the same from MoEFCC. 5. The project proponent shall obtain permission from CGWA/PGWRA for abstraction of ground water (if required) and shall comply with the guidelines issued by it from time to time. 6. The project proponent and its occupants shall fulfill its responsibility as a bulk waste generator and shall comply with the provisions of Solid waste management Rules, 2016. 7. The project proponent shall ensure compliance to the comprehensive guidelines for the regulation of noise/ sound pollution caused by use of loud speakers, public address system etc. issued by Punjab Government, Deptt. of Science, Technology & Environment vide notification no. 3/100/2013-STP(4)/145 dated 26.02.2014. 8. The Consent is being issued to the project proponent based upon the undertakings/documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time. 9. The project proponent must obtain all the necessary permissions and regulatory clearances from the relevant departments and agencies of the state government, in accordance with the project's specific guidelines as per the per state government laws. 10. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the promoter.
