It is submitted that earlier the Public Sand Mining Project (Sand) was granted Consent to operate under the Water Act, 1974 & the Air Act, 1981 vide no. CTOW/Fresh/MOG/2023/24005549 & CTOA/Fresh/MOG/2023/24005383 dated 02.11.2023 for Mining of minor minerals (Sand) @ 223124 TPA under orange category for operation of mining site measuring 45 acre (18.21 hectare) in the revenue estate of Village Adraman, Tehsil Dharamkot, District Moga bearing khasra nos. 20//16, 17, 22, 23, 24, 25, 21//18, 19, 20, 21, 22, 23, 24, 25, 38//7, 14, 17, 5, 6, 15, 16, 37//1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 36//1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 35//1, 10, valid upto 31.12.2023 with conditions mentioned therein.
Now, Public Sand Mining Project (Sand) has applied for varied Consent to operate under the Water Act, 1974 & the Air Act, 1981 through OCMMS for Mining of minor minerals (Sand) @ 48113.93 TPA for operation of mining site within the existing land area of 45 acre (18.21 hectare), detail of the case is as under:
• The Public Sand Mining site has already submitted project cost chart, showing total cost of the project will be 732.06 lacs. Accordingly, it has already deposited consent fee of Rs. 84400/- (Rs. 64800/- vide UTR / Ref. NO. AXSK233030029407 dated 30.10.2023 & Rs. 21600/- vide UTR / Ref. NO. AXSK241210007711 dated 30.04.2024) under Water Act, 1974 and Rs. 84400/- (Rs. 64800/- vide UTR / Ref. NO. AXSK233030029439 dated 30.10.2023 & Rs. 21600/- vide UTR / Ref. NO. AXSK241210007982 dated 30.04.2024) under the Air Act, 1981, which is adequate upto 30.09.2027 under both the Acts
• The Public Sand Mining site has submitted copy of Environment Clearance (EC) vide file no. 2024/EC/F/33 dated 18.04.2024 issued by the State Environment Impact Assessment Authority (SEIAA), Punjab.
Further, the Public Sand Mining site has submitted in compliance to the clarification raised that: "Earlier, the Total Quantity of (Public mining site) Adraman Sand Mining Project was 2,23,124 MT. Due to change in depth of mining site the SEIAA reduced the total quantity of mining site 2,11,255.79 MT. Now the annual quantity of this site is 48113.93 MT(excluding already extracted quantity 66,914 MT)".
To process the application, the mining site was visited by undersigned (AEE) on 18.05.2024 and it was observed as under:
1. The site was not in operation.
2. The Public Sand Mining site has demarked the area of mining site.
3. There has provided portable toilets & bathroom at mining site.
4. The Public Sand Mining site has shown moveable water carrying tankers for sprinkling of water for suppression of dust arising during the activity.
5. The mining site was in process of developing plantation along the boundary of site.
6. The Public Sand Mining site has provided weighing bridge.
In view of the above, mining site of the Public Sand Mining site is complying with provisions of the Air Act, 1981.
It is therefore recommended that consent to operate under the Air Act, 1981 may be granted to the Public Sand Mining site for the period upto 30.09.2027 under Water Act, 1974 and Air Act, 1981 for mining of minor minerals (Sand) @ 48113.93 TPA over an area of 45 acre (18.21 hectare) located at village Adraman, Tehsil Dharamkot, District Moga for operation of mining site, subject to the suitable conditions and specific as under:
1. The Consent to operate is valid for measuring 45 acre (18.21 hectare) in the revenue estate of Village Adraman, Tehsil Dharamkot, District Moga bearing khasra nos. 20//16, 17, 22, 23, 24, 25, 21//18, 19, 20, 21, 22, 23, 24, 25, 38//7, 14, 17, 5, 6, 15, 16, 37//1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 36//1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 35//1, 10 for mining of minor minerals (Sand) @ 223124 TPA.
2. The Public Mining Site shall comply with the conditions of mining plan for mining site at Village Adraman, Tehsil Dharamkot, District Moga and shall mining as per mining plan issued by Drainage-cum-mining & Geology Division, Water Resources Department, Punjab.
3. The Public Mining Site shall comply with the conditions of letter issued by State Level Environment Impact Assessment Authority Punjab, Ministry of Environment, Forest & Climate Change, Government of India, O/o Directorate of Environment & Climate Change MGSIPA Complex, Sector 26, Chandigarh-160019 vide no. SEIAA/MS/2023/1825 dated 19.10.2023.
4. The Public Sand Mining shall comply with terms & conditions of approval letter for approval of mining plan of Minor Mineral of Village Adraman, Tehsil Dharamkot vide no. Glg/Pb./M.P./Adraman/1348 dated 21.05.2023 approved by Assistant Geologist, Mines & Geology, Water Resources Department, Punjab, Chandigarh.
5. The Public Mining Site will properly demark the area of mining site with pillars and fencing etc, within 15 days.
6. The mining of minor minerals (sand) shall be carried out only upto a depth of 3 meters as proposed in the approved mining plan.
7. The Public Mining Site shall undertake plantation / afforestation work by planting the native species in the nearby area to mine lease.
8. The Public Mining Site will not discharge any air emissions during mining and transportation of minor minerals. It shall use covered vehicles for transportation of the material and shall regularly maintain the road under use.
9. The Public Mining Site will make arrangement for regular sprinkling of water at vehicle movement area to suppress the dust emissions generated during movement of vehicles.
