It is submitted that while scrutinized the case it has been observed that: -
1. Previous consent application applied by the resort on 31.03.2023 was returned to the resort on 10.04.2023 due to following incompletions: -
(a) The appropriate category of the resort is not mentioned;
(b) Consent fee for adequate time period is not deposited;
(c) Compliance of latest guidelines issued by CPCB for such units.
But resort has not submitted the reply the above said observation this time also.
2. CA certificate submitted by the resort is of dated 16.08.2022.
Hence, the resort is required to submit the latest CA Certificate, so that adequacy of consent fee already deposited by the resort may be adjudged and resort is also required to deposit the penalty amount for not obtaining the consent of the Board as prescribed by the Board.
3. Earlier, the resort has obtained the Consents to operate under the Water Act, 1974 and the Air Act, 1981, hence the Resort was required to apply for renewal of Consent, but the resort has applied for New Consent, Please clarify?
4. Please submit the Land Use Pattern /CLU of the Resort from the Competent Authority.
5. Please submit the copy of approved site plan of the Resort from Competent Authority.
The resort was requested to attend the above said observations and submit your reply within 2 days.
The reply submitted by the resort is incomplete, as it has not submitted the reply of Sr.No. (1) and (3).
The resort was visited by Sh. Ashwinder Singh, AEE(OS) on 21.05.2024 (copy attached) and observed as under:-
1. The resort has not provided the fixed pipeline for disposal of treated waste water from the STP to onto land for plantation.
2. The owner of (Big Resort and Best Resort) has submitted an undertaking for using composting pits being constructed inside the premises of Big resort for scientific disposal of solid waste generated by the resort.
In light of above, incomplete application cannot be processed and is required to be returned, but I have no option to return the application.
Please allow me to return the application with the request to resort to re-submit the same after attending the above said observations and complete in all respects at the earliest. |
