Sir, the industry is a small scale, orange category unit and was granted ‘consent to operate’ under the Water Act, 1974 and Air Act, 1981dated 08.08.2023 both were valid upto 07.02.2024 and electric connection of the industry was also restored temporarily fox six months i.e. upto 07.02.2024.
Thereafter, a complaint was received from the residents of village Tibba regarding noise pollution/ vibrations originating from the use of 03 drop hammers (capacity 1.25 Ton, 1.75 Ton & 2.75 Ton) the industry. The industry was issued show cause notice for revocation of consent to operate granted under Water Act, 1974 and Air Act, 1981 with an opportunity of personal hearing before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 05.12.2023 in which following decisions were taken:-
1. The industry shall not operate the new installed additional hammer of 2.75 Ton Capacity.
2. The industry shall submit an affidavit/undertaking within 15 days for shifting of unit to designated area, within 03 months.
3. The Environmental Engineer, Regional Office shall visit the industry to verify the contention of the industry, seal the hammer of 2.75 Ton Capacity, carried noise monitoring report for the operation of remaining hammers after 15 days and submit further recommendation in the matter.
In compliance to the above said decisions, the industry was visited by RO on 31.01.2024 and it was reported as under:- 1. During visit industry was in operation. 2. It has installed 3 hammer of capacity 1.25 Ton, 1.75 Ton & 2.75 Ton respectively out of which only 1 hammer of capacity 1.75 Ton was in operation. 3. During visit 1 hammer of capacity 2.75 Ton has been sealed (i.e. from the Pully & V-Belts from the top) 4. The noise level was measured and the noise monitoring parameters reveals that the contribution of the industry in noise monitoring is more than 10 dB(A) at street end backside working shed to words villagers) 5. The industry has not provided the adequate stack height and sampling arrangements with the stack of heating furnace of 1.25 Ton hammer. 6. It has not provided the Stack height to its shot Blast machine. 7. It has not provided Hazardous Waste storage room. 8. It has provided septic tank to treat the domestic effluent, but plantation area is yet to be developed by the industry. 9. As per decision of personal hearing dated 05.12.2023, the industry has not submitted an affidavit/undertaking for shifting of unit to designated area, within 03 months in this office so far.
Hence, the industry was issued notice to issue direction u/s 33-A of the Water Act, 1974 with an opportunity of personal hearing before the Chief Environmental Engineer, Ludhiana on 28.03.2024, wherein it was decided that no further extension in the restoration period of electric connection is granted by the Board. So, the Environmental Engineer, Regional Office shall get the earlier issued directions complied with from PSPCL. In compliance to the above said decision the PSPCL authorities were requested accordingly and the PSPCL authorities have disconnected the electric connection of the industry.
Now, the industry has applied for consent to operate under the Water Act, 1974 and Air Act, 1981 for manufacturing of auto parts @ 4.3 TPD using M S Steel @ 6.0 TPD as raw material and restore of electric connection of the industry alongwith requisite document and fee.
The site of the industry was visited by RO on 15.05.2024 and it was reported as under:- 1. The industry was in not in operation and electric connection of the industry was lying disconnected from the electricity pole. 2. It has installed 3 hammer of capacity 1.25 Ton, 1.75 Ton & 2.75 Ton respectively out of which 1 hammer of capacity 2.75 Ton was lying sealed. 3. Now, it has provided the adequate stack height with the stack of heating furnace of 1.25 Ton hammer. 4. Now, It has provided the Stack height to its shot Blast machine. 5. Now, It has provided the Hazardous Waste storage room of size 10’*9’*9’ with lock and Key facility. 6. It has provided septic tank to treat the domestic effluent and now, it has developed appox. 700 Sq.ft. plantation area to discharge the treated domestic effluent in its premises and appox. 1200 sq.ft. area was being developed by the industry as observed during visit. 7. Now, It has submitted the copy of letter dated 29.03.2024 (addressed to Zonal Office) that they will shift the factory by Dec., 2024 as per agreement made with the villagers of Tibba. 8. The industry is having submersible pumps as source of fresh water. 9. The industry has submitted CLU from STP, Ludhiana vide no. 4083 dated 01.10.2018 which mentioning that the site falls in industrial zone as per Master Plan, Ludhiana (2007-31). 10. The industry has submitted building plan from Architect approved by the Director of Factory, Punjab. 11. The consent fee deposited by the industry is adequate upto 30.04.2025.
In view of the above, it is recommended that: -
1. Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 may be granted to the industry for six months.
2. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 may be issued for restoration of electric connection of the industry temporally for six months, please.
