File Note: It is intimated that the industry had applied for obtaining renewal of ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. However, the said application was refused by the Board on 12/04/2023. Thereafter, the industry was issued a show cause notice for violations of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, alongwith an opportunity of personal hearing on 28.03.2024 before the Senior Environmental Engineer (P) of the Board vide letter no. 28 dated 01.04.2024 and it was decided as under: 1) The industry shall apply for consent to operate as required under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981, within 10-days alongwith requisite documents and consent fee to the Board. 2) The industry shall comply observations earlier made by the visiting officer of the Board on 14/3/2024. Also, the industry shall not discharge it treated/ untreated effluent outlet its premises in an illegal manner. 3) The industry shall submit bank guarantee of Rs. 1.0 Lakh as an assurance to comply with environmental laws as well as decision no. 1 and 2 as mentioned above within 7-days to the O/o Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar. 4) Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar shall visit the industry surprisingly after 10-days to verify the compliance of environmental laws made by the industry and thereafter process the consent applications on merits. Accordingly, as per decision no. 03 from the hearing held on 28.03.2024, the industry has submitted a Bank Guaranty amounting to Rs. 01 lakh vide bearing no. 5065424BG0000017 dated 06.05.2024, having validity upto 05.05.2025. Now, the project proponent has applied for obtaining Fresh ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for production of Gravure cylinder with electroplating @ 12000 Number/Year, alongwith an requisite documents. The industry has deposited Rs. 18,100/- vide UTR. no. N063221858484346 dated 04.03.2022 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 15,900/- vide UTR. no. N063221858507242 dated 04.03.2022 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 30.09.2026 (Considering of NOC fee @ Rs. 2200 and penalty as Rs. 4400/- for each Acts) for both the Acts against the fixed assets of Rs. 15.72 lakhs on 23.02.2023 (Considering the value of lease amount also). The industry has also submitted a copy of building plan signed by Sh. Jasvir Singh, Competent Person, under the Factories Act, 1948. The industry has submitted a copy of GST registration certificated dated 14.07.2021, as a proof of date of commissioning of the unit, alongwith the online application form. Suitability of Site: The industry has submitted a classification of land use issued by DTP, SAS Nagar vide letter no. 404 dated 14.03.2022, wherein it has mentioned that Khasra no. 167/6 total 00 Bigha, 16 Biswa, 14 Biswasi is falls under ‘F.E.Z’ as per Proposed Land Use Plan, Lalru as such the site of suitable for setting up of the unit. The unit has submitted a copy of the lease deed executed between Sh. Gulshan Gulial (1st party) and M/s Balaji Gravers Enterprises (2nd party) regarding lease of land bearing Khasra no. 167/6 (0-16-14) total 00 Bigha, 16 Biswe, which is valid for five years, w.e.f. 01.03.2022. Visit: Accordingly, the site of the industry was visited by AEE of this office on 23.05.2024 and it was observed as under: 1. The industry is engaged in the process of Gravure cylinder with electroplating. 2. The industry has installed 01 tubewell in its premises and flow meter is provided with the same. 3. The industry has installed 06 no. of tubs/tanks for washing and plating of rollers in its premises. 4. The industry has installed 01 underground tank of capacity 5 KL for storage of trade effluent being generated from the process and the representative of the industry informed that the operator of CETP lifts the trade effluent from this tank directly. Presently, around 2000 ltrs of effluent was lying stored in the said tank. 5. The industry has executed an agreement dated 26.02.2022 with M/s Bantech Water Private Limited, Kurali for lifting of trade effluent @ 2000 ltrs/month. 6. The industry is also maintaining record of listing of trade effluent by the operator of CETP, M/s Bantech Water Pvt. Ltd., and as per the record maintained, details of last 02 lifting is as under: a. 1000 ltr on 24.04.2024 b. 1000 ltr. On 20.03.2024 7. The industry has not installed any DG set from its premises. 8. The industry has installed one tank for chrome plating in its premises. The industry has provided wet scrubber as APCD followed by stack of height 03 mtr. above ground level, to contain the emissions being generated from said tank. 9. The industry has constructed a 02 stage septic tank for the domestic effluent being generated from the unit, after passing through which, the same is discharged onto land for plantation developed in front of boundary wall. From above, it is clear that the industry is now complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Recommendations: In the above, if may approved, the industry may be granted ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 upto 30/09/2026, subject to suitable conditions and additional conditions that: 1. The industry shall maintain proper record of the freshwater to be consumed in its process at all times. 2. The industry shall provide a dip level indicator/gauge at its trade effluent storage tank, within 15 days, so as to enable the Board to check the quantity of effluent present in the said tank, at any point of time. 3. The industry shall get its trade effluent lifted through operator of CETP, only and shall maintain a proper record of lifting of the same, at all times. 4. The industry shall not discharge the effluent into any drain/choe/nallah, in any case. 5. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation at any time, under any circumstances. 6. The industry obtain permission from PWRDA for abstraction of groundwater (if required) and shall comply with the guidelines issued by PWRDA from time to time. 7. The industry shall get its final building plan approved from Director of Factories within 02 months and shall submit a copy of the same to the Board within 15 days thereafter. 8. The industry shall ensure that due to operation of the project at the site, no nuisance for general public is created at any time and no public complaints are received. 9. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 10. The unit shall ensure that no nuisance is created in the vicinity of its premises from the operations of its service station. In case, any complaint is received against the unit, the Board shall be at liberty to revoke/ cancel this consent without giving any opportunity of hearing to the industry. 11. The adequacy/ efficacy of the pollution control and disposal arrangements shall be the sole responsibility of the project proponent and the project proponent shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 12. The Consent is being granted to the industry based upon the undertaking/ documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time. 13. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
