It is intimated that the above industry is a cupola furnace established and commissioned without obtaining NOC/Consents of the Board.
Earlier, SCN had been issued vide letter no. 249-50 dated 27/01/2022 and the Competent Authority has directed to RO to seal the Cupola furnace installed without APCD, immediately. Further, the industry was visited on 16/03/2022 and it was observed that the unit is a cupola furnace and was not in operation during visit. The unit has not provided wet cap/APCD on its cupola furnace. During visit ID Fan of cupola furnace was sealed in the presence of Sh. Tripan Kumar (Munchi). The proprietor of the industry Sh. Rajesh Goyal (Prop.) was informed telephonically regarding sealing of the unit and report of the same has sent to Zonal Office Amritsar vide this office letter no. 541 dated 17/03/2022 for information.
Thereafter, the industry was again visited under Environment Surveillance Campaign on 14/12/2022 and observed as under:-
1. The cupola furnace installed by the industry was not in operation during visit. However, it observed that casting process has done by the industry.
2. The industry has provided wet cap as APCD on the cupola furnace and sealed were broken by the industry which were earlier done by this office.
3. The industry has not has applied for obtaining consent to operate under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 from the Board till date.
As above, the industry broken seals without intimation to this office and has operated its furnace without consents of the Board.
Further, the Board has issued directions under section 31-A of the Air (Prevention & Control of Pollution) Act, 1981 vide letter no. 271 dated 31/01/2023 to the industry and to PSPCL Authorities under section 31-A of the Air (Prevention & Control of Pollution) Act, 1981 vide letter no. 266-69 dated 31/01/2023 to the industry which are reproduced as under:-
"That the authorities concerned shall disconnect the electric connection of subject cited industry with immediate effect and not to restore the same without prior permission of Punjab Pollution Control Board."
Accordingly, this office was requested to the Executive Engineer (Distribution), Punjab State Power Corporation Ltd., Suburban-Division, Batala (North) & the Assistant Engineer, Punjab State Power Corporation Limited, Suburban-Division, Batala (North) vide this office letter no. 405-406 dated 28/02/2023 to submit compliance of the directions issued by the Board but no reply was submitted by the authorities to this office. The authorities were again requested vide this office letter 619-20 dated 05/03/2023 to submit compliance of the directions issued by the Board, but till date the Authorities have not submitted compliance of the directions issued by the Board.
Now the industry has applied for obtaining fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The project proponent has submitted various documents, which are enclosed along with the application, which may kindly be pursued.
The PSCST, Chandigarh has certified vide letter no. PSCST/TFD/509 dated 27/10/2022 that the industry has installed cupola furnace and air pollution control device having melting capacity less than 3T/hr as per the technology evolved by PSTST, Chandigarh.
The industry has submitted the land use classification receipts from E.O, Municipal Corporation, Batala vide No. PB/GUR/Batal/218496 dated 10/05/2024, (Copy Enclosed), in which it has applied for obtaining clearance of its industrial building, which may kindly be perused.
The industry has submitted the approved industrial building plan issued by Municipal Corporation, Batala vide No. PB/GUR/BATAL/218496 dated 22/05/2024. (Copy enclosed)
The industry has deposited Rs. 23,900/- vide UTR No. 917134217 dated 17/05/2024 & Rs. 25,200/- vide UTR No. 568820829 dated 17/05/2024 as consent to operate fee under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 including Rs. 500/- as Form Downloading fee against total gross value of fixed assets worth Rs. 11,93,564/- as on 31/03/2023 and same are adequate upto 30/06/2025 under both Acts including Rs. 1800/- as NOC Regularization fee and Rs. 500/- as FDF. The industry was visited by the officer of this office on 17/05/2024 and observed as under:-
1. The industry was not in operation during the visit.
2. The electric connection of the industry was found disconnected.
3. The industry has installed a cupola furnace with wet cap as an APCD.
4. The industry has constructed a re-circulation tank with pump motor fitted over it.
5. The industry has erected a pipe network for the re-circulation of the scrubbed water.
6. There is no source of trade effluent.
The project falls in Orange category in small scale sector, hence competency to decide the case lies with the Senior Environmental Engineer of the Board in the light of directions issued.
In view of above, mention effects this office is of the opinion that that the request of the industry may be considered and recommended as under::-
1. The consent to operate under Water (Prevention& control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 may be granted for six months period.
2. PSPCL Authorities may be directed to restore electric connection of the unit temporarily for six months period.
