File Note: • The industry was granted 'consent to establish' (NOC) under the provisions of the Water Act, 1974 & Air Act, 1981 on 31.07.2023 (Valid upto 31.07.2024) for establishment of pyrolysis plant for production of Pyrolysis oil @ 8 TPD by processing Waste Tyres @ 20 TPD in the revenue estate of village Sadarwala, Tehsil and District Sri Muktsar Sahib with 02 reactor of capacity 10 TPD each………. • A complaint has been received in the Board from Gram Panchayat, Kabarwala (Sadarwala) regarding the nuisance being created by the operation of the industry………… • Now, the industry has applied for obtaining 'consents to operate' under the provisions of the Water Act, 1974 & Air Act, 1981……….. • The site of the industry was visited by the officer of the Board on 01.04.2024 and it was observed that:- 1. The industry has yet not installed the flare mechanism and has also provided a bye-pass system with reactor for flaring of gas, in case of emergency…………. 2. The industry has provided a mechanism to remove the carbon from the reactor through cloth type material and the same is feeded to plastic bags for storage……….. 3. The industry has provided single row of plantation/saplings along the boundary wall………… 4. The industry has yet not submitted any certificate from the concerned authorities regarding the adoption of safety measures in compliance to the notification dated 15.10.2014………….. 5. The industry is not complying with the 'Standard Operating Procedures' (SOPs) issued by CPCB on 16.01.2024 prescribed for re-cycling of waste tyre scrap for the recovery of tyre pyrolysis oil, pyro gas and char………… 6. The industry is not complying with all the conditions imposed by the Site Appraisal Committee in the site clearance granted to it dated 17.05.2023………….. • In view of above, show cause notice before refusal of 'consents to operate 'under the provisions of the Water Act, 1974 & Air Act, 1981 has been issued to the industry alongwith an opportunity of personal hearing before the Senior Environmental Engineer on 29.04.2024……………. • During hearing, Sh. Hardev Singh, Prop. of the industry submitted written reply w.r.t. notice issued to it, which has taken on record. He further stated that:- 1. Flare mechanism provided with the reactor at the farthest point……….. 2. Proper mechanism provided for removing of the carbon from the reactor and for filling in HDPE bags………… 3. Triple row of plantation/saplings provided along the boundary wall……….. 4. Application applied for obtaining certificate from the concerned authorities regarding the adoption of safety measures in compliance to the notification dated 15.10.2014………… 5. As per the conditions imposed in the certificate issued by the Site Appraisal Committee dated 17.05.2023, strip/chip cutting machines/shredder has not been provided by the industry as the uncut tyre is sent to the reactor for production of pyrolysis oil, gas & Char. During hearing, it was deliberated that the 'Standard Operating Procedures' (SOPs) issued by CPCB on 16.01.2024 for re-cycling of waste tyre scrap for recovery of pyrolysis oil, gas & Char is still under consideration with the Board and the industry will be directed to comply with said SOPs after receipt of any formal communication from the Higher Authorities…………. • After hearing, the Prop. of the industry as well as the officer of the Board, it has been decided that by the Senior Environmental Engineer of the Board that the Environmental Engineer, Regional Office, Bathinda shall visit the site of industry to verify the submission made by the prop. of industry and process the consent applications applied by it under Water Act, 1974 & Air Act, 1981, on merits…….. • Now, the Regional Office vide note dated 22.05.2024 has reported that the industry has neither provided pneumatic/screw conveyor systems for removal of carbon powder from the reactor nor conveyor system for bagging of carbon powder & with the installation of alkali scrubber along-with 30 meter stack height with bagging plant and has failed to submit the certificate from the concerned authorities regarding the adoption of safety measures in compliance to the notification dated 15.10.2014……….. • If approved, the application applied by the applicant under Water Act, 1974 and Air Act, 1981 be refused as it has failed to comply with the conditions of the NOC as well as failed to comply with the decision of the personal dated 29.04.2024…….. • Competency : SEE
