The perusal of the case in reference to the note of the Assistant Environmental Engineer dated 26.02.2024 shows that the prosecution is being launched for the construction carried out in the expansion area and is not related with the present consent to operate renewal applications, which has also mentioned deemed approval on 28.02.2024.
In view of the above position, I do not find any restriction for renewal of consent to operate to the project proponent under the Air (Prevention and Control of Pollution) Act, 1981 which may be granted with suitable conditions as proposed by the Regional Office. However, if there is any violation with regard to environmental norms, action may be taken accordingly.
